  22. is they are far from it. They often claim they want people to change

  25. repressive actions to lobby and legislate against the will of others.

  337. employee pretended to work for the CIA to get unlimited
  338. vacations and one worker even spent most of his time on the
  339. clock looking at pornography.

  341.  It appears, however, that a regional office has reached a new
  342. low: Management for Region 8 in Denver, Colo., wrote an email
  343. earlier this year to all staff in the area pleading with them
  344. to stop inappropriate bathroom behavior, including defecating
  345. in the hallway.

  352. Protection Agency hired an outside consultant to inform their
  353. employees that pooping in hallways is bad.

  355.  Government Executive got their hands on an email from the
  356. management EPA�s Region 8 in Denver, Colo., in which a supervisor
  357. begged his employees to stop �placing feces in the hallway� and
  358. clogging up toilets with paper towels. While this is, obviously,
  359. a very disgusting matter, the story veers into pretty dumb
  360. territory soon:

  362.  Confounded by what to make of this occurrence, EPA management
  363. �consulted� with workplace violence �national expert� John
  364. Nicoletti, who said that hallway feces is in fact a health and
  365. safety risk. He added the behavior was �very dangerous� and the
  366. individuals responsible would �probably escalate� their actions.
  367.  
  368.  According to his bio, Nicoletti is, indeed, a nationally-recognized
  369. expert on workplace and school violence prevention, with accolades
  370. from the National Science Foundation and numerous chairmanships.
  371. He�s even �a member of NASA�s team for developing analog�s for
  372. training astronauts for long duration missions, such as the
  373. Mars Mission.�

  375.  Why such a distinguished mind was consulted by the EPA to reach
  376. the conclusion that �placing feces in the hallway� is bad, we�ll

  404. fluorescent light bulbs are considered the norm.
  405. The incandescent light bulbs use more power, but
  406. they are also warmer and serve an important role
  407. inside incubators.

  409.  �As the light bulb is on, it will obviously warm
  410. things up and then the setting will turn it off to
  411. keep the right temperature,� explained Mireille
  412. Goguen, who works at the centre.

  414.  She said they were caught off-guard by the bulb
  415. ban and they are already running short on
  416. incandescent bulbs. Now they are asking people
  417. to donate 100-watt bulbs.

  419.  �(We will take) as many as possible. If people
  420. have them hanging around we will take them or if
  421. they want to buy them for us it would be much
  422. appreciated,� said Goguen.

  445.  �This is a terrible plan. It�s terrible because
  446. the solution is worse than the so-called problem,�
  447. said Arabo. �It�s a classic case of politicians
  448. attempting to do something for the environment,
  449. in part to appease some environmental groups,
  450. without seeing the bigger picture.�

  452.  The proposed ban would remove plastic bags from
  453. stores while imposing a paper bag tax on customers.
  454. Shoppers would be charged 10 cents for each paper
  455. bag they might need at a store.

  457.  �This ban will have reaching ramifications. It�ll
  458. cost taxpayers � mothers, fathers and brothers �
  459. more money when they go shopping for groceries,�
  460. said Arabo.
  461.  
  462.  Though the ban is designed to reduce waste and
  463. help the environment, Arabo argued that plastic
  464. bags only make up one-third of one percent of
  465. the waste stream.

  467.  On the other end of the plastic bag ban debate,

  478. how to achieve that.

  480.  First the city of Chico had the ban on nuclear weapons,
  481. then wood-burning stoves, then plastic bags. Now
  482. comes a ban on high-flow toilets. And if you think
  483. the city can�t enforce that, then you haven�t met
  484. the toilet police.

  486.  OK, so the title �Toilet Police� probably doesn�t
  487. appear on any city worker�s business card, but
  488. that�s what they are.
  489.  
  490.  But let�s not blame city building inspectors for
  491. an odd law � or even the Chico City Council. For
  492. once, this ridiculous save-the-world concept doesn�t
  493. come from the council, but rather from the busybodies
  494. in the state Legislature. They passed a law that took
  495. effect Jan. 1 that requires water-conserving plumbing
  496. fixtures on any home built before 1994.
  497.  
  498.  How will that be enforced? Well, if a property has
  499. any work done that requires a building permit from
  500. a city or county, that entity�s inspector must verify
  501. that the home has low-flow toilets, showers and faucets.
  502.  
  503.  To make it even more disturbing, the low-flow
  504. inspection doesn�t occur if you�re getting plumbing
  505. work. It occurs if you�re getting any work that requires
  506. a building permit, such as getting a new heater, new
  507. windows or converting a garage into a den. Uh, maybe.
  508.  
  509.  So under the letter of the law, if a homeowner buys
  510. a new water heater or fireplace insert for a couple
  511. hundred dollars, he or she might spend considerably
  512. more than that converting all toilets, faucets and
  513. showerheads to low-flow devices.
  514.  
  515.  City and county building inspectors don�t want to be
  516. toilet police. We can�t imagine them wanting to spend
  517. time checking a person�s toilet when they�re there
  518. to check an air conditioner. They�re taking a loose
  519. interpretation of the law for now, and won�t inspect
  520. toilets during projects like repairs and maintenance
  521. that don�t involve plumbing.
  522.  
  523.  But there�s no guarantee the state, which passed
  524. the law, won�t require cities and counties to enforce
  525. a strict interpretation.
  526.  
  527.  With all the uncertainty, it entices a homeowner to
  528. ignore the government requirement to get a building
  529. permit for minor home improvement projects.
  530.  
  531.  Governments should be concerned if fewer people take
  532. out building permits. It means less revenue for
  533. cash-strapped local governments.
  534.  
  535.  The building industry is concerned that residents
  536. may put off rebuilding and home improvement projects
  537. because they would include this unwanted expense.
  538. With the building industry and contractors finally
  539. showing signs of recovery from the recession, we
  540. don�t want to see new obstacles.
  541.  
  542.  Once again the state passes a goofy law without
  543. thinking about the consequences, since somebody else
  544. has to enforce it. The city and county building
  545. departments urge residents not to be scared off by
  546. the new laws, to call and ask questions. It seems
  547. they are like the rest of us, trying to figure out
  548. how long they can ignore the fools in Sacramento
  549. before they get caught.

  604. it could take private homes within half a mile of

  607. really private if it could be taken at any time

  610.  According to Lawrence J. McQuillan, �each Authority
  611. will be granted powers to build �Sustainable Communities�
  612. means jamming people into dense, urban centers using
  613. high-density residential housing and high-intensity

  615. corridors. To that end, SB 1 will grant each
  616. Authority unprecedented powers.�

  618.  Eminent domain has gradually grown to be one of the
  619. most oppressive government policies. Since the
  620. SCOTUS� decision in Kelo v. City of New London,
  621. eminent domain continues to be the enemy of property
  622. owners. Homeowners have lost their homes to private

  624. their land than they originally paid for it. Businesses
  625. have even been forced to sell their buildings to

  659.  The new standards are the result of a mandate first
  660. set in motion in 2007 by Congress, and later by an
  661. Executive Order issued by President Obama in May of
  662. last year. The regulations will apply to medium and
  663. heavy-duty trucks built in 2014 through 2018, aimed
  664. at reducing annual national fuel consumption by 530
  665. million barrels.

  667.  The new regulations will be aimed at one of three
  668. specific subsets of trucks: combination tractors
  669. (commonly referred to as semi-trucks), heavy-duty
  670. pickup trucks and vans and vocational vehicles.

  672.  Each category will have its own regulations, but

  674. much as 20 percent by 2018, which is the case for

  715. Obama Admitted Plan Would Raise Electricity Rates

  717.  There is some evidence that President Obama has a
  718. deliberate strategy of increasing electricity rates and
  719. destroying the coal industry.

  721.  �Under my plan of a cap-and-trade system, electricity
  722. rates would necessarily skyrocket,� Obama told the editorial
  723. board of The San Francisco Chronicle in 2008. �Even
  724. regardless of what I say about whether coal is good or
  725. bad. Because I�m capping greenhouse gases, coal power
  726. plants, you know, natural gas, you name it � whatever
  727. the plants were, whatever the industry was, they would
  728. have to, retrofit their operations. That will cost money.
  729. They will pass that money on to consumers.�
  730.  
  731.  �So if somebody wants to build a coal-powered plant,
  732. they can; it�s just that it will bankrupt them,� Obama
  733. said, �because they�re going to be charged a huge sum for
  734. all that greenhouse gas that�s being emitted.�
  735.  
  736.  Obama�s prediction about coal plants have been proven
  737. true. As Off The Grid News previously reported, in October
  738. 2013, FirstEnergy Corp announced that it would shut down
  739. two coal-fired powered plants in Pennsylvania because it
  740. said the cost of complying with EPA regulations was too high.
  741.  
  742.  Reuters estimated that coal-burning power plants capable
  743. of generating 15,000 megawatts of electricity have shut
  744. down since Obama took office in 2009. The news service
  745. also estimates that power plants that generate around
  746. 37,000 megawatts of power will close in the next 10
  747. years. One megawatt can provide electricity to up to
  748. about 1,000 homes.

  750. Awfully Expensive Electricity
  751.  
  752.  Those plants will be closing at a time when demand for
  753. electricity is increasing. That will force utilities to
  754. build power plants that burn other fuels such as natural
  755. gas. It will add additional cost to electricity rates at
  756. a time when the rates are already going up dramatically.
  757.  
  758.  �It could get awfully expensive,� Daniel Simmons of the
  759. Institute for Energy Research told World Net Daily. �Some
  760. people might see their electricity rates double. If there�s
  761. no backup power plants, that means electricity is going to
  762. get awfully expensive when you have shortages around the
  763. country.
  764.  
  765. Another Obama Plan To Raise Your Electric Bill
  766.  
  767.  �We�re talking about dramatically increasing the cost of
  768. electricity all to reduce carbon dioxide emissions. I
  769. think that is the real goal,� Simmons said.

  771.  Another Obama administration plan to reduce greenhouse
  772. emissions, Carbon Capture and Sequestration, or CSS technology,
  773. could raise electricity costs even more, Simmons predicted.
  774. He noted that a an experimental CSS power plant in the
  775. United States will cost an estimated $4.3 billion to build
  776. and the EPA doesn�t know if the technology would work.

  778.  �The technology is awfully expensive because it hasn�t
  779. been tried anywhere, and that�s to try to capture the
  780. carbon dioxide as it comes out after they burn the coal.�
  781. Simmons said of CSS.

  783.  CSS involves the use of filters to divert carbon emissions
  784. from the air � and every taxpaying American will pay. The
  785. CSS plants under construction will require $300 million in
  786. taxpayer subsidies.

  788.  US Senator Joe Manchin of West Virginia has been critical
  789. of the Obama administration�s policy on coal.

  791.  �This Administration is trying to hold the coal industry
  792. to impossible standards,� Manchin said. �Never before has

  866. countries will come to us for the technology once
  867. we�ve developed it.

  869.  �And so if we can figure out a carbon-capture mechanism
  870. that is sufficiently advanced and works, then we are
  871. helping ourselves, because the Chinese and the Indians
  872. are going to build some coal plants, and even if we
  873. don�t build another coal plant in this country, there
  874. are going to be a lot of coal plants around the world
  875. that are built,� Obama told the New Yorker.

  877.  �And we have a huge investment in trying to figure
  878. out how we can help them do it more cleanly,� he added.

  880.  Obama hopes that by requiring new US coal plants to
  881. use CCS technologies, the country could become a world
  882. leader and export the technology abroad when other
  883. nations can afford it. If the US doesn�t lead, Obama
  884. argues, other countries will not follow.

  887. stop,� Obama said. �We�re going to have to give them
  888. some help. We�re going to have to take some of our
  889. research and development on things like clean-coal
  890. technology and be able to export it to them or license

  892. help them leapfrog some of the development stages
  893. that we went through.�

  911.  The Chinese greenlit 100 million metric tons of new
  912. coal production capacity last year as part of the
  913. government�s plan to bring 860 million metric tons
  914. of coal production online by 2015.

  916.  The US coal industry, however, says CCS is not yet
  917. proven technology as there are no commercial-scale
  918. coal plants in the country that uses the technology.
  919. In fact, when the Environmental Protection Agency
  920. wrote its rule limiting coal plant emissions it only
  921. cited CCS projects that were government funded and
  922. not in operation.
  923.  
  924.  �It is disingenuous to state that the technology is
  925. �ready,�� said Charles McConnell, former assistant
  926. secretary of energy in Obama. �Studies have verified
  927. that implementation of [CSS] technology is necessary
  928. to comply with EPA�s proposed [EPA carbon-emissions
  929. limits] regulation and meet the [greenhouse gas]
  930. targets necessary for limiting CO2 emissions to our
  931. atmosphere.�

  1120. No one in PG&E/ SCE/ SDG&E areas of California have
  1121. been disconnected solely for refusal to pay �opt out�
  1122. fees, and thousands have been ignoring toothless
  1123. disconnect warnings and deducting the fees from their
  1124. bill every month.  Why are utilities going to such
  1125. lengths to silence critics of their smart meter
  1126. policies?�

  1128.  So-called �smart� meters are not UL approved and have
  1129. never been safety-tested.  But according to grid
  1130. engineering firms such as Raab Associates they are
  1131. part of a technology roadmap which includes �mining

  1134. even more troubling is the connection between �smart�

  1571.  I remember very distinctly the attitude on the
  1572. Georgia Tech campus toward the environmental �science�
  1573. department. I�m sure that much of what was studied by
  1574. environmental science majors was legitimate, especially
  1575. as it concerned local phenomena and processes. But
  1576. when it comes to the global aspects of environmental
  1577. science (weather systems, causation, the long-term
  1578. effects of pollution, etc.), it becomes obvious that
  1579. environmental scientists are less reliable than
  1580. weathermen and relying heavily on extremely speculative
  1581. models of explanation.

  1583.  Pollution is defined by concentrations. Nothing that
  1584. is considered a pollutant is necessarily bad intrinsically
  1585. or necessarily. Even toxic elements occur naturally at
  1586. low concentrations. The EPA determines what those
  1587. concentrations are allowed to be in order to still
  1588. be considered �safe.� And recently, the EPA has been
  1589. narrowing those regulations even further, most recently
  1590. in an attempt to force businesses to �go green.� But
  1591. as it turns out, for years, the EPA has created and
  1592. enforced regulations based on data that it pawned off
  1593. as �hard science� that is impossible to reproduce
  1594. independently. It was secret science. Pet science.

  2050. scheduled for Wednesday, May 7, Patrick Sullivan, an
  2051. assistant EPA inspector general for investigations, is
  2052. expected to provide compelling evidence of an extraordinary
  2053. abuse of power � even for Barack Obama � by the all but
  2054. unknown EPA Office of Homeland Security.
  2055.  
  2056. The Associated Press reports:
  2057.  
  2058.  The office of about 10 employees is overseen by EPA
  2059. Administrator Gina McCarthy�s office, and the inspector
  2060. general�s office is accusing it of impeding its independent
  2061. investigations into employee misconduct, computer security
  2062. and external threats, including compelling employees
  2063. involved in cases to sign non-disclosure agreements.
  2064.  
  2065.  �Under the heavy cloak of national security, the Office
  2066. of Homeland Security has repeatedly rebuffed and refused
  2067. to cooperate with the OIG�s ongoing requests for information
  2068. or cooperation,� Sullivan wrote in prepared testimony
  2069. obtained by The Associated Press. �This block unquestionably
  2070. has hamstrung the Office of Inspector General�s ability to
  2071. carry out its statutory mandate to investigate wrongdoing
  2072. of EPA employees.�
  2073.  
  2074.  In other words, a unit within the EPA that is under the
  2075. direct control of the White House and its political associates
  2076. is using the �national security� trope to actively prevent
  2077. investigations into EPA violations of the law. Given the
  2078. high profile of their benefactor, this group fears no
  2079. repercussions. ... ...
  2080.  
  2081.  Representative Darrell Issa (R-Calif), a frequent foe
  2082. of the Obama administration, is advantageously positioned
  2083. to put the screws to the president in this scandal, as
  2084. well. As chairman of the House Oversight and Government
  2085. Reform Committee, Issa will be heading the investigation
  2086. in the White House�s secret EPA squelch squad. �It�s
  2087. disturbing that even investigations by this administration�s
  2088. own nonpartisan watchdogs are being blocked by political
  2089. appointees,� Issa said, as quoted by the AP.
  2090.  
  2091.  Given the EPA�s egregious disregard for the Constitution
  2092. and the formerly unalienable rights of life, liberty, and
  2093. property, it is little wonder that the president�s political
  2094. team has spiked any investigation that might expose to the
  2095. light of public notice the truth of the agency�s reign of
  2096. terror. The evidence is overwhelming.
  2097.  
  2098.  Two years ago, the Supreme Court handed the EPA (and the
  2099. Obama administration) an unfavorable ruling in the case of
  2100. Sackett v. US, but it�s the events leading up to that high
  2101. court hearing that boil the blood of constitutionalists
  2102. and property owners. As reported by William Jasper, senior
  2103. editor of The New American:
  2104.  
  2105.  How long would your bank account hold out if an agency of
  2106. the federal government were fining you $75,000 per day? A
  2107. couple of hours, maybe � or a few minutes? Not many
  2108. homeowners could handle that kind of crushing financial
  2109. blow. Even a Bill Gates, a Warren Buffett, or a George
  2110. Soros might blanch at such astronomical fines.
  2111.  
  2112.  But that was the potential cost facing Idaho couple Mike
  2113. and Chantelle Sackett ... who ran into the iron fist of
  2114. the Environmental Protection Agency (EPA) when they began
  2115. building their home in 2007 on a two-thirds acre parcel in
  2116. a residential neighborhood of Priest Lake. Like their
  2117. neighbors who had already built homes next door, the
  2118. Sacketts got their permits from the county and began
  2119. laying gravel and preparing the ground for building.
  2120. That�s when the EPA came in and, without hearings or
  2121. notice, declared that the property is �wetlands� and
  2122. ordered the Sacketts to restore it to the EPA bureaucracy�s
  2123. satisfaction.
  2124.  
  2125.  The Sacketts, having good reasons to believe their
  2126. property is not a wetlands, were determined to contest
  2127. the EPA order. However, the EPA denied their request for
  2128. a hearing. They sought judicial relief, but the US Ninth
  2129. Circuit Court of Appeals sided with the EPA, ruling that
  2130. the Sacketts had no right to immediate judicial review
  2131. of the matter. The Ninth Circuit held that the couple
  2132. would first have to go through the EPA�s years-long
  2133. wetlands permit process, which would end up costing the
  2134. property owners many times the value of their land!
  2135.  
  2136.  Basically, a group of unelected and unaccountable federal
  2137. officials has shattered the dreams of the Sackett family,
  2138. robbed them of the due process of law guaranteed to every
  2139. citizen by the Constitution, and charged them $75,000 a
  2140. day for the privilege.
  2141.  
  2142.  The Sacketts understood the enormity of the issue raised
  2143. by their pouring of a little gravel on less than an acre
  2144. of land. Said Mrs. Sackett in the days leading up to the
  2145. Supreme Court decision, �The EPA can come in and turn your
  2146. life upside down. They can make you feel really small and
  2147. insignificant. And they take away from you your sense of
  2148. America.�
  2149.  
  2150.  The EPA is not content to obliterate property rights,
  2151. however. Recent actions taken against the country's last
  2152. lead smelting facility will affect the right to keep and
  2153. bear arms, as well, by substantially impacting the production
  2154. of ammunition. On December 31, 2013, the lead refining plant
  2155. closed for good.
  2156.  
  2157.  The St. Louis Post-Dispatch reported just before the
  2158. shuttering of the plant:
  2159.  
  2160.  About 145 employees of the Doe Run lead smelter [in Herculaneum,
  2161. Missouri] learned they will lose their jobs at the end of
  2162. December because of the plant�s closure, the Doe Run Co.
  2163. said Wednesday. An additional 73 contractor jobs also will
  2164. be eliminated.
  2165.  
  2166.  By forcibly closing this plant, the Obama administration
  2167. took yet another unconstitutional step � one that will
  2168. severely impinge on the nation�s ammunition-manufacturing
  2169. capability.
  2170.  
  2171.  Why would the Doe Run Company, the owners of the Missouri
  2172. lead smelting facility, agree to being run out of business
  2173. by the EPA? One word: extortion.
  2174.  
  2175.  In a document published on its website, the EPA explains
  2176. that in order for Doe Run to continue its operations, the
  2177. company would have to agree to pay �$65 million to correct
  2178. violations of several environmental laws at 10 of its lead
  2179. mining, milling and smelting facilities in southeast Missouri.
  2180. The settlement also requires the company to pay a $7 million
  2181. civil penalty.�
  2182.  
  2183.  In a statement to the press, Doe Run said the fine and the
  2184. required upgrades to its facilities were �too financially
  2185. risky.�
  2186.  
  2187.  In cases such as those of the Sacketts, the Doe Run smelting
  2188. facility, and scores of others nationwide, the EPA�s heavy
  2189. handed, unconstitutional tactics should have been investigated
  2190. and the nearly unbounded power should have been reined in.
  2191.  
  2192.  They carried on without oversight, however, and perhaps
  2193. now we know why.
  2194.  
  2195.  Many who have felt the wrath of the dictators�s shadowy
  2196. EPA division are hopeful that the House�s committee hearings
  2197. will finally expose the group�s many misdeeds.

  2205.  A Silicon Valley billionaire will be forced to testify
  2206. on Monday as surfers battle venture capitalist Vindo Khosl
  2207. over access to a popular northern California beach. The
  2208. case may be the most significant challenge to the state�s
  2209. public access laws.

  2211.  According to the San Francisco Chronicle, the Surfrider
  2212. Foundation has accused Khosla �of flouting the California
  2213. Coastal Act when he blocked the only road into Martins
  2214. Beach� from the public.

  2216.  A lawyer for Khosla�s company countered and said that,
  2217. �Surfrider, in this lawsuit, is asking to protect an
  2218. access right that simply doesn�t exist.� But they were
  2219. denied their motion to prevent Khosla from testifying in
  2220. the matter, and Khosla will have to do so on Monday as
  2221. the trial resumes.

  2223.  As the Chronicle noted, a 1972 �California Coastal Zone
  2224. Conservation Initiative� made the �entire coast public
  2225. property, including beaches below the mean high tide,�
  2226. and the lawsuit presents the biggest challenge to that
  2227. initiative.

  2229.  Khosla �is famous for his backing of bold, eco-friendly
  2230. projects and is a darling of Democratic politicians,� and
  2231. is company paid �$37.5 million for the property, which
  2232. includes 45 leased cabins along the coastal cliffs.�

  2234.  Surfrider is claiming that since the �closed gate means
  2235. the only way people can get there is from the ocean,�
  2236. Khosla is in violation of the �public access provisions
  2237. in the coastal act.�

  2239.  Lawyers for Martins Beach have also weighed in, saying the
  2240. previous historic $5 �beach fees prove that the public never
  2241. had a right to access that beach.�

  2400. commissioner warned that such behavior could lead to �agri-

  2404. at Mechanicsburg�s Joseph T. Simpson Public Library back in April,
  2405. they thought it would be a useful way for locals to borrow seeds

  2408. key self-sufficiency skills.

  2421.  A recent review carried out by the organization GRAIN revealed that
  2422. small farms produce most of the world's food and are more productively
  2423. efficient than large farms.
  2424.  
  2425.  Facilitated by an appropriate policy framework, small farmers could easily
  2426. feed the global population. However, small farmers are currently squeezed
  2427. onto less than a quarter of the world's farmland. The world is fast losing
  2428. farms and farmers through the concentration of land into the hands of the
  2429. rich and powerful. The report concluded that if nothing is done to reverse
  2430. this trend, the world will lose its capacity to feed itself.
  2431.  
  2432.  One major reason why small farms are disappearing is the rapid growth of
  2433. monoculture plantations. In the last 50 years, 140 million hectares - well
  2434. more than all the farmland in China - have been taken over for soybean,
  2435. oil palm, rapeseed and sugar cane alone. By definition, peasant agriculture
  2436. prioritizes food production for local and national markets as well as for
  2437. farmers' own families, whereas corporations take over scarce fertile land
  2438. and prioritize commodities or export crops for profit and markets far away
  2439. that cater for the needs of the affluent.
  2440.  
  2441.  This process impoverishes local communities and brings about food insecurity.
  2442. GRAIN's Camila Montecinos concludes that the concentration of fertile agricultural
  2443. land in fewer and fewer hands is directly related to the increasing number
  2444. of people going hungry every day. While industrial farms have enormous power,
  2445. influence and resources, GRAIN's data review showed that small farms almost
  2446. everywhere outperform big farms in terms of productivity.
  2447.  
  2448.  On the heels of the review by GRAIN is a new report from the policy think
  2449. tank the Oakland Institute which states that the first years of the 21st
  2450. century will be remembered for a global land rush of nearly unprecedented
  2451. scale. An estimated 500 million acres, an area eight times the size of Britain,
  2452. was reported bought or leased across the developing world between 2000 and
  2453. 2011, often at the expense of local food security and land rights.
  2454.  
  2455.  The Oakland Institute indicates how a new generation of institutional investors,
  2456. including hedge funds, private equity, pension funds and university endowments,
  2457. is eager to capitalize on global farmland as a new and highly desirable asset
  2458. class. Financial returns, not food security, are what matter.
  2459.  
  2460.  And this trend is not confined to the much publicized buying up of valuable
  2461. agricultural land in low-income by foreign concerns. The Institute's Executive
  2462. Director, Anuradha Mittal, argues that although media coverage tends to focus
  2463. on land grabs in these countries, there is also a new rush for US farmland.
  2464. With rising interest from investors and surging land prices, giant pension
  2465. funds like TIAA-CREF are committing billions to buy agricultural land.
  2466.  
  2467.  She states that one industry leader estimates that ten billion dollars in
  2468. institutional capital is looking for access to US farmland, but that figure
  2469. could easily rise as investors seek to ride out uncertain financial times by
  2470. placing their money in the perceived safety of agriculture. The US will
  2471. experiences an unprecedented crisis of retiring farmers over the next 20
  2472. years, leading to ample opportunities for these actors to expand their
  2473. holdings as an estimated 400 million acres changes generational hands.
  2474.  
  2475.  Mittal argues that for all their size and ambition, virtually nothing is known
  2476. about these new investors and their business practices. Who do they buy land
  2477. from? What do they grow? How do they manage their properties? She concludes
  2478. that in an industry not known for its transparency, none of these questions
  2479. have a satisfactory answer.
  2480.  
  2481.  The corporate consolidation of agriculture is being felt just as strongly in
  2482. Iowa and California as it is in the Philippines and Mozambique. Mittal notes
  2483. that some of the most powerful players involved in these major land acquisitions
  2484. include: UBS Agrivest, a subsidiary of the biggest bank in Switzerland; the
  2485. Hancock Agricultural Investment Group (HAIG), a subsidiary of the biggest
  2486. insurance company in Canada; and the Teacher Annuity Insurance Association
  2487. College Retirement Equities Fund (TIAA-CREF), one of the largest pension funds
  2488. in the world.
  2489.  
  2490.  Mittal argues that this is crucial to look at the motives and practices of
  2491. these major players because although institutional investors only currently
  2492. own an apparently tiny one percent of all US farmland and farmers are still
  2493. the biggest buyers of farmland across the country, the writing is on the wall
  2494. in terms of the long-term trends that threaten US agriculture.
  2495.  
  2496.  Investors believe that there is roughly 1.8 trillion dollars' worth of farmland
  2497. across the US. According to the Oakland Institute, of this between 300 and 500
  2498. billion dollars is considered to be of �institutional quality,� a combination
  2499. of factors relating to size, water access, soil quality, and location that
  2500. determine the investment appeal of a property. This makes domestic farmland
  2501. a huge and largely untapped asset class. Some of the biggest actors in the
  2502. financial sector have already sought to exploit this opportunity by making
  2503. equity investments in farmland. Frequently, these buyers enter the market
  2504. with so much capital that their funds are practically limitless compared with
  2505. the resources of most farmers.
  2506.  
  2507.  Anuradha Mittal notes that they have made an impressive foothold and that
  2508. this is the beginning, not the end, of a land rush. Not only is there space
  2509. in the market for institutional investors to expand, but there are also major
  2510. financial incentives for them to do so. She argues that if action is not taken,
  2511. then a perfect storm of global and national trends could converge to permanently
  2512. shift farm ownership from family businesses to institutional investors and other
  2513. consolidated corporate operations.
  2514.  
  2515.  A September 2013 report by the United Nations Conference on Trade and Development
  2516. stated that farming in rich and poor nations alike should shift from monoculture
  2517. towards greater varieties of crops, reduced use of fertilizers and other inputs,
  2518. greater support for small-scale farmers and more locally focused production and
  2519. consumption of food. The report stated that monoculture and industrial farming
  2520. methods are not providing sufficient affordable food where it is needed. The
  2521. system actually causes food poverty, not addresses it, something which people
  2522. like Vandana Shiva have been saying for some time.
  2523.  
  2524.  Numerous high level reports from the UN and development agencies have argued
  2525. in favor of small farmers and agro-ecology. However, the bedrock of food
  2526. production and food security - the small farmer - faces marginalization and
  2527. economic distress. The trends in favor of �asset-based', corporate-dictated

  2542. livelihood of oyster farmers.  Zoning is a popular way for
  2543. counties to control where and how things are bought and
  2544. sold. Zoning ordinances can often dictate whether people
  2545. can work, live and play in the same neighborhood. The
  2546. details of zoning are excruciatingly complex leaving people
  2547. unable to respond in a timely manner. The enforcement of
  2548. zoning regulations involves heavy fines and/or incarceration.
  2549. In short, zoning has been a terrific way for counties to
  2550. control people�s lives.
  2551.  
  2552.  Such is the story of oyster farmer Anthony Bavuso and his
  2553. family. After years of working corporate and office jobs,
  2554. Bavuso and his wife took a short hiatus from the day-to-day
  2555. drudgery and returned with a new perspective: they wanted to
  2556. become contributors to the economy of raw materials by producing
  2557. something that people needed.
  2558.  
  2559.  Bavuso moved his family back to their home state of Virginia
  2560. with the dream of becoming food producers. Having access to a
  2561. waterfront property, and a background in oyster gardening, it
  2562. made sense to start an oyster farm. Like other types of farming,
  2563. oyster farmers have to manage the growth of their oysters � a
  2564. labor-intensive process requiring a high level of experience.
  2565. An added benefit, for Bavuso, was the knowledge that oysters
  2566. clean the water. As a lifelong Virginian, the health of the
  2567. Chesapeake Bay is never far from his mind. (Oysters eat algae,
  2568. which proliferates in the pollution of the bay, and turn the
  2569. algae into usable protein for humans.)  So the Bavuso family
  2570. started Seaford Oyster Company in Seaford, Virginia.
  2571.  
  2572.  York County maintains a set of zoning ordinances regulating
  2573. various aspects of farming.  There are a list of things that
  2574. are allowed, and if an activity is not on the list, the county
  2575. prohibits it. Penalties include steep fines and possible
  2576. incarceration. Small changes to the zoning ordinances can
  2577. easily disrupt industries and people�s livelihoods.
  2578.  
  2579.  In 2010, Bavuso followed regulatory procedure within his zoning
  2580. district for an oyster farm. He established a lease with the
  2581. Commonwealth of Virginia that gave him the �rights� to the
  2582. section of the bottomland in the Poquoson River adjacent to
  2583. his property. (The bottom lease gives farmers access to
  2584. shellfish only.) Additional regulations and permits involved
  2585. food safety. Wanting to show his interest in producing the
  2586. safest food possible, Bavuso complied with the entire permitting
  2587. process.
  2588.  
  2589.  Prior to starting the farm, the family looked at this list of
  2590. zones and restrictions. In the Bavuso�s zone, farming is �permitted
  2591. by right.� This means for people to farm the land, they need no
  2592. additional land use permits from the county. According to the
  2593. definition of aquaculture in the code, what Bavuso is doing is
  2594. considered part of what is �permitted by right.�
  2595.  
  2596.  By 2011, after more than a year of farming, refining his expertise
  2597. and growing his customer base, Bavuso read in a local newspaper
  2598. that the county was planning on rezoning to remove agriculture
  2599. activities from Bavuso�s �zone.� A �zone� is any area that the
  2600. county designates. Within each zone, the county stipulates what
  2601. particular activities can take place. Once designated, the county
  2602. applies regulations and restrictions. For example, one common
  2603. zoning requirement is that if an area is zoned for residential
  2604. building, there are restrictions and regulations determining
  2605. how from the property line a structure can be built.
  2606.  
  2607.  Bavuso wanted to make sure that he would be grandfathered in and
  2608. that these changes would not affect his farming operation. He
  2609. didn�t know it at the time, but the ordinance was crafted to
  2610. punish a fellow oyster farmer by the name of Greg Garrett. The
  2611. rezoning effort was a actually a political vendetta to punish
  2612. Garrett for supporting a challenger to a currently elected
  2613. member of the York County Board of Supervisors (BOS). Bavuso
  2614. has gotten caught up in that because he does not agree with
  2615. the agenda of the BOS either. And so began what would be at
  2616. least 3 years of limbo for a peaceful man and his family. After
  2617. his vocal opposition, Mr. Bavuso is now is convinced that they
  2618. are attacking him, personally.

  2701.  The proposed standard is 1,100 pounds of CO2 per megawatt
  2702. hour of electricity produced. Today�s most advanced commercial
  2703. coal power plants emit 1,800 pounds of CO2 per megawatt hour.
  2704. New plants could comply only by installing carbon capture and
  2705. storage (CCS) technology � a capability that can add 80% to
  2706. the cost of building a new coal plant.
  2707.  
  2708.  To make the proposal look reasonable, EPA has to bend reality
  2709. a lot. Under section 111(b) of the Clean Air Act, NSPS are to
  2710. reflect the �best system of emission reduction� that has been
  2711. �adequately demonstrated.� EPA claims CCS is adequately
  2712. demonstrated -- but there are no commercial-scale power
  2713. plants operating anywhere with CCS, and none is being built
  2714. without heavy taxpayer and/or consumer subsidies.

  2716.  In short, a utility that builds a new coal plant with CCS,
  2717. as required by EPA�s ruling, risks going bankrupt. The rule
  2718. is thus an informal ban on investment in new coal power

  2765. by the Center for Food Safety and beekeepers.

  2767.  The agency is proposing more uses for thiamethoxam,
  2768. apesticide that has been banned in the European Union
  2769. because it is considered a threat to bees. A letter from
  2770. the Center to the Environmental Protection Agency raises
  2771. some serious concerns about thiamethoxam and another
  2772. pesticide, sulfoxaflor.

  2774.  �Peer-reviewed scientific studies have consistently shown
  2775. that these systemic chemicals are highly toxic to honeybees,
  2776. other pollinators and beneficial insects,� the letter

  2790. neonicotinoids. AHarvard study this year also tied bee

  2823.  Johnson said the EPA has engaged him in a power play and is

  2825. the pond, which they claim is actually a �dam.�

  2839. followed state regulations in building it. He has an approval
  2840. etter from the Wyoming State Engineer�s Office as proof, which
  2841. states:

  2843.  �Said permit is in good standing and is entitled to be exercised
  2844. exactly as permitted,� says the letter.
  2845.  
  2846.  The agency is threatening to hit the family with up to $75,000 a
  2847. DAY in fines. Johnson said he�s not paying them a cent:

  2849.  �I have not paid them a dime nor will I. I will go bankrupt if I
  2850. have to fighting it. My wife and I built [the pond] together. We
  2851. put our blood, sweat and tears into it. It was our dream.�
  2852.  
  2853.  Of course, the EPA isn�t backing down. They argue that Johnson
  2854. needs to either restore the land or pay the fines. On January 30,
  2855. the agency gave Johnson 30 days to hire a consultant to assess the
  2856. impact of the supposed unauthorized work and to create a restoration
  2857. proposal. That proposal has to be approved by the EPA, of course,
  2858. and it must contain a schedule. All work would have to be completed
  2859. within 60 days of the plan�s approval.
  2860.  
  2861.  Sounds like they are setting him for failure, doesn�t it? Even if
  2862. he DID violate the law and agreed to make things right, would meeting
  2863. those terms even be possible?
  2864.  
  2865.  If Johnson does not comply with those terms, the EPA is going to
  2866. fine him $37,500 per day in civil penalties, along with $37,500 more
  2867. every day for statutory violations.
  2868.  
  2869.  Johnson is fighting back and has gained the support of three Republican
  2870. senators � John Barrasso and Mike Enzi, who both represent Wyoming �
  2871. and Louisiana Sen. David Vitter, Fox News reports:
  2872.  
  2873.  The Republican lawmakers sent a March 12 letter to Nancy Stoner, the
  2874. EPA�s acting assistant administration for water, saying they were
  2875. �troubled� by Johnson�s case and demanding the EPA withdraw the
  2876. compliance order.

  2878.  �Rather than a sober administration of the Clean Water Act, the
  2879. Compliance Order reads like a draconian edict of a heavy-handed
  2880. bureaucracy,� the letter states.
  2881.  
  2882.  The letter also questions the EPA�s claim that Johnson�s pond is
  2883. actually a dam:
  2884.  
  2885.  �Fairness and due process require the EPA base its compliance order
  2886. on more than an assumption,� they wrote. �Instead of treating Mr.
  2887. Johnson as guilty until he proves his innocence by demonstrating his
  2888. entitlement to the Clean Water Act section 404 (f)(1)(C) stock pond
  2889. exemption, EPA should make its case that a dam was built and that the
  2890. Section 404 exemption does not apply.

  2892.  �If the compliance order stands as an example of how EPA intends
  2893. to operate after completing its current �waters of the United States�
  2894. rule-making, it should give pause to each and every landowner throughout
  2895. the country.�

  2897.  Johnson said his battle with the EPA is serving as a learning
  2898. experience for his children:
  2899.  
  2900.  �This is showing them that they shouldn�t back down. If you need to
  2901. stand up and fight, you do it.
  2902.  
  2903.  �This goes a lot further than a pond. It�s about a person�s rights. I
  2904. have three little kids. I am not going to roll over and let [the government]
  2905. tell me what I can do on my land. I followed the rules.�

  2907.  The infringement on Johnson�s property rights under the veil of
  2908. protecting the environment is bad enough, but some say that the
  2909. astronomical fines are perhaps an even bigger issue � and may even
  2910. be unconstitutional, as Evan Bernick of The Foundry explains:

  2912.  But the eye-popping aspect of this story is the severity of the
  2913. penalties threatened. It�s absurd to threaten someone with tens of
  2914. thousands of dollars in fines because he or she lacks a permit. And
  2915. it might also be unconstitutional.
  2916.  
  2917.  The Framers of our Constitution recognized that, at a certain point,
  2918. penalties become unconstitutionally disproportionate. The Eighth
  2919. Amendment�s Excessive Fines Clause reflects that understanding. In
  2920. Austin v. U.S. (1993), and again in U.S. v. Bajakajian (1998), the
  2921. U.S. Supreme Court explained that �[t]he Excessive Fines Clause
  2922. limits the government�s power to extract payments, whether in cash
  2923. or in kind, as punishment for some offense,� and held that civil
  2924. sanctions that do not serve solely remedial purposes are subject
  2925. to the Excessive Fines Clause. It is impossible to understand the
  2926. threatened fines as serving a purely remedial purpose�surely,
  2927. repairing any damage that Johnson inflicted would cost less than
  2928. $75,000 a day. But, under the terms of the CWA, he is potentially
  2929. subject to such penalties as a consequence of his failure to obtain
  2930. a permit.

  2971.  The green office isn�t merely a desk and telephone tucked away
  2972. in the dark corner of a nondescript government building. It�s a
  2973. substantial undertaking, with all the luxury, bells and whistles
  2974. of a bureaucracy that means business. Eric K. Shinseki, who
  2975. resigned as secretary in the wake of the VA scandal of the sin
  2976. of omission, traveled the country to boast of the green initiative.
  2977. In one instance, he traveled to Massachusetts to flick the switch
  2978. at a half-million-dollar windmill project at the Massachusetts
  2979. National Cemetery. �Nationally,� he said, �VA continues to expand
  2980. its investment in renewable sources of energy to promote our
  2981. nation�s energy independence, save taxpayer dollars, and improve
  2982. care for our veterans and their families.

  2986. Calverton National Cemetery spent $742,034 on solar panels. Fort
  2987. Rosecrans National Cemetery spent $787,308. Not to be out-greened,
  2988. the Riverside National Cemetery spent $1.3 million on its solar
  2989. system.

  2991.  At the Phoenix VA Health Care System, where 20 Americans died from
  2992. incompetence and cover-up, the department spent $20 million putting
  2993. solar panels on the hospital roofs. That would have been more than
  2994. enough money to provide the veterans with the health care they deserved.

  2996.  Some administrators won�t be satisfied until every federal building
  2997. bears a green stamp. In military parlance, the VA is practicing
  2998. �mission creep,� the expansion of a project well beyond its intended
  2999. goals. While the rest of the government continues to waste taxpayer
  3000. funds trying to become carbon-dioxide neutral, the VA should be
  3001. spending every available dollar to relieve pain, cure the sick and
  3002. restore the deserving to health. That�s more important than any fad,

  3016. claiming authority to bypass the courts and unilaterally garnish
  3017. paychecks of those accused of violating its rules, a power currently
  3018. used by agencies such as the Internal Revenue Service.

  3020.  The EPA has been flexing its regulatory muscle under dictator Obama,
  3021. collecting more fines each year and hitting individuals with costly
  3022. penalties for violating environmental rules, including recently
  3023. slapping a $75,000 fine on Wyoming homeowner Andy Johnson for
  3024. building a pond on his rural property.
  3025.  
  3026.  �The EPA has a history of overreaching its authority. It seems
  3027. like once again the EPA is trying to take power it doesn�t have
  3028. away from American citizens,� Sen. John Barrasso, Wyoming Republican,
  3029. said when he learned of the EPA�s wage garnishment scheme.
  3030.  
  3031.  Others questioned why the EPA decided to strengthen its collection
  3032. muscle at this time.
  3033.  
  3034.  Critics said the threat of garnishing wages would be a powerful
  3035. incentive for people to agree to expensive settlements rather than
  3036. fight EPA charges.
  3037.  
  3038.  EPA officials did not respond to repeated questions by The Washington
  3039. Times about why they thought it was necessary to garnish people�s wages.
  3040.  
  3041.  The EPA announced the plan last week in a notice in the Federal
  3042. Register, saying federal law allows it �to garnish non-Federal
  3043. wages to collect delinquent non-tax debts owed the United States
  3044. without first obtaining a court order.�
  3045.  
  3046.  The agency cited authority under the Debt Collection Improvement
  3047. Act of 1996 that centralized federal collection operations under
  3048. the Treasury Department, which oversees garnishments of wages or
  3049. tax refund checks.
  3050.  
  3051.  Under the law, every federal agency has the authority to conduct
  3052. administrative wage garnishment, provided the agency adopts
  3053. approved rules for conducting hearings where debtors can challenge
  3054. the amount of debt or terms of repayment schedule, a Treasury
  3055. official said.
  3056.  
  3057.  Still, the rule would give the EPA sweeping authority to dictate
  3058. how and whether Americans could dispute fines and penalties, even
  3059. as the amount of EPA fines collected from individuals, businesses
  3060. and local governments steadily increase.
  3061.  
  3062.  The amount of fines raked in by the agency has jumped from $96
  3063. million in 2009 to $252 million in 2012, a more than 160 percent
  3064. increase, according to EPA annual reports.
  3065.  
  3066.  Putting the collection powers on a fast track, the agency announced
  3067. it in the Federal Register as a �direct final rule� that would take
  3068. effect automatically Sept. 2, unless the EPA receives adverse public
  3069. comments by Aug. 1.
  3070.  
  3071.  The EPA said it deemed the action as not a �significant regulatory
  3072. action� and therefore not subject to review.
  3073.  
  3074. The negative reactions began almost immediately.
  3075.  
  3076.  In a comment letter submitted to the EPA, the conservative Heritage
  3077. Foundation faulted the rule for giving the government �unbridled
  3078. discretion� in controlling the process for challenging fines and
  3079. wage garnishment, such as dictating the site of a hearing without
  3080. consideration of the time and travel expense placed on the accused
  3081. debtor.

  3083.  The rule allows the EPA to decide whether a debtor gets a chance
  3084. to present a defense and then picks whomever it chooses to serve as
  3085. a hearing officer, even someone not trained as an administrative
  3086. law judge, wrote David S. Addington, group vice president for
  3087. research at The Heritage Foundation.
  3088.  
  3089.  It also puts the burden of proof on the debtor, not the EPA,
  3090. he said.
  3091.  
  3092.  The EPA has been on the front lines of the battle over Mr. Obama�s
  3093. climate change agenda, including issuing proposed rules that would
  3094. require coal-fired power plants to cut carbon dioxide emissions by
  3095. 30 percent over 15 years.

  3097.  Critics say it will cause massive increases in the cost of electricity,
  3098. lead to power shortages and eliminate jobs, while making scant impact
  3099. on the amount of greenhouse gasses emitted worldwide.

  3101.  The agency has been a magnet for criticism over new rules on things
  3102. such as wood-burning stoves and small streams or ponds on private
  3103. land, including waterways on farms and golf courses.

  3154. hike, surf, and enjoy the great outdoors in all sorts of ways. I love
  3155. wildlife. A broad empty vista is a beautiful thing to me. I revel in a
  3156. starry sky devoid of human light.

  3158.  But I am not about to flush the property rights of my fellow human beings
  3159. just because I enjoy these things. I am certainly not willing to give power
  3160. to disconnected bureaucrats who have little regard for the welfare and
  3161. livelihoods of people who make their living from the land (or ocean) just
  3162. because I happen to want to take a stroll without being impacted by others.

  3164.  I believe that capitalism is in many ways more �sustainable� (especially
  3165. when accounting for �externalities� and when incorporating sound money)
  3166. than heavy handed, top down socialism. I�ve written about this in the past.
  3167. There is no greater enemy of the environment than the state. There is no
  3168. greater enemy of personal liberty than the state either.

  3170.  With so called �public lands� a balance must be struck between the people
  3171. who mix their efforts with the land to produce wealth, and �sustainability�
  3172. concerns. Just because someone in Washington DC decides that a pretty piece
  3173. of land should be devoid of human impact doesn�t mean that the state suddenly
  3174. has the moral authority to kick people out. They did that to the people who
  3175. lived on the Blue Ridge Mountains just to my west during the Depression. The
  3176. feds sometimes burned houses down as families watched their meager possessions
  3177. (including dogs which were ordered to be locked inside of houses) go up in flames.
