  304. employee pretended to work for the CIA to get unlimited
  305. vacations and one worker even spent most of his time on the
  306. clock looking at pornography.

  308.  It appears, however, that a regional office has reached a new
  309. low: Management for Region 8 in Denver, Colo., wrote an email
  310. earlier this year to all staff in the area pleading with them
  311. to stop inappropriate bathroom behavior, including defecating
  312. in the hallway.

  319. Protection Agency hired an outside consultant to inform their
  320. employees that pooping in hallways is bad.

  322.  Government Executive got their hands on an email from the
  323. management EPA�s Region 8 in Denver, Colo., in which a supervisor
  324. begged his employees to stop �placing feces in the hallway� and
  325. clogging up toilets with paper towels. While this is, obviously,
  326. a very disgusting matter, the story veers into pretty dumb
  327. territory soon:

  329.  Confounded by what to make of this occurrence, EPA management
  330. �consulted� with workplace violence �national expert� John
  331. Nicoletti, who said that hallway feces is in fact a health and
  332. safety risk. He added the behavior was �very dangerous� and the
  333. individuals responsible would �probably escalate� their actions.

  335.  According to his bio, Nicoletti is, indeed, a nationally-recognized
  336. expert on workplace and school violence prevention, with accolades
  337. from the National Science Foundation and numerous chairmanships.
  338. He�s even �a member of NASA�s team for developing analog�s for
  339. training astronauts for long duration missions, such as the
  340. Mars Mission.�

  342.  Why such a distinguished mind was consulted by the EPA to reach
  343. the conclusion that �placing feces in the hallway� is bad, we�ll

  359. out for incandescent light bulbs, which it uses to
  360. provide warmth for injured and recovering birds,
  361. after the federal government banned manufacturers
  362. from making the bulbs.

  364.  In Canada, the more energy-efficient compact
  365. fluorescent light bulbs are considered the norm.
  366. The incandescent light bulbs use more power, but
  367. they are also warmer and serve an important role
  368. inside incubators.

  370.  �As the light bulb is on, it will obviously warm
  371. things up and then the setting will turn it off to
  372. keep the right temperature,� explained Mireille
  373. Goguen, who works at the centre.
  374.  
  375.  She said they were caught off-guard by the bulb
  376. ban and they are already running short on
  377. incandescent bulbs. Now they are asking people
  378. to donate 100-watt bulbs.
  379.  
  380.  �(We will take) as many as possible. If people
  381. have them hanging around we will take them or if
  382. they want to buy them for us it would be much
  383. appreciated,� said Goguen.
  384.  
  385.  Donations can be dropped off at the centre,
  386. which is located on Moodie Drive in the city�s
  387. west end.

  395. Wednesday to call on the San Diego City Council to
  396. abandon the plan to remove plastic bags from local
  397. stores.

  400. of the Neighborhood Market Association, held a press
  401. conference in front of Rainbow Market on Federal
  402. Boulevard in which they called the proposed ban a
  403. tax scam that will negatively impact working-class
  404. San Diegans.

  406.  �This is a terrible plan. It�s terrible because
  407. the solution is worse than the so-called problem,�
  408. said Arabo. �It�s a classic case of politicians
  409. attempting to do something for the environment,
  410. in part to appease some environmental groups,
  411. without seeing the bigger picture.�

  413.  The proposed ban would remove plastic bags from
  414. stores while imposing a paper bag tax on customers.
  415. Shoppers would be charged 10 cents for each paper
  416. bag they might need at a store.

  418.  �This ban will have reaching ramifications. It�ll
  419. cost taxpayers � mothers, fathers and brothers �
  420. more money when they go shopping for groceries,�
  421. said Arabo.
  422.  
  423.  Though the ban is designed to reduce waste and
  424. help the environment, Arabo argued that plastic
  425. bags only make up one-third of one percent of
  426. the waste stream.

  428.  On the other end of the plastic bag ban debate,
  429. Sherri Lightner, San Diego City Council President
  430. Pro Tem, District 1, supports the proposed ban.

  438. in all homes, but obviously didn�t think long about
  439. how to achieve that.

  441.  First the city of Chico had the ban on nuclear weapons,
  442. then wood-burning stoves, then plastic bags. Now
  443. comes a ban on high-flow toilets. And if you think
  444. the city can�t enforce that, then you haven�t met
  445. the toilet police.

  447.  OK, so the title �Toilet Police� probably doesn�t
  448. appear on any city worker�s business card, but
  449. that�s what they are.
  450.  
  451.  But let�s not blame city building inspectors for
  452. an odd law � or even the Chico City Council. For
  453. once, this ridiculous save-the-world concept doesn�t
  454. come from the council, but rather from the busybodies
  455. in the state Legislature. They passed a law that took
  456. effect Jan. 1 that requires water-conserving plumbing
  457. fixtures on any home built before 1994.
  458.  
  459.  How will that be enforced? Well, if a property has
  460. any work done that requires a building permit from
  461. a city or county, that entity�s inspector must verify
  462. that the home has low-flow toilets, showers and faucets.
  463.  
  464.  To make it even more disturbing, the low-flow
  465. inspection doesn�t occur if you�re getting plumbing
  466. work. It occurs if you�re getting any work that requires
  467. a building permit, such as getting a new heater, new
  468. windows or converting a garage into a den. Uh, maybe.
  469.  
  470.  So under the letter of the law, if a homeowner buys

  484.  But there�s no guarantee the state, which passed
  485. the law, won�t require cities and counties to enforce
  486. a strict interpretation.

  489. ignore the government requirement to get a building

  492.  Governments should be concerned if fewer people take
  493. out building permits. It means less revenue for

  580. most oppressive government policies. Since the
  581. SCOTUS� decision in Kelo v. City of New London,

  583. owners. Homeowners have lost their homes to private

  585. their land than they originally paid for it. Businesses

  626. million barrels.

  684. board of The San Francisco Chronicle in 2008. �Even
  685. regardless of what I say about whether coal is good or

  687. plants, you know, natural gas, you name it � whatever
  688. the plants were, whatever the industry was, they would
  689. have to, retrofit their operations. That will cost money.
  690. They will pass that money on to consumers.�

  692.  �So if somebody wants to build a coal-powered plant,
  693. they can; it�s just that it will bankrupt them,� Obama
  694. said, �because they�re going to be charged a huge sum for
  695. all that greenhouse gas that�s being emitted.�

  697.  Obama�s prediction about coal plants have been proven
  698. true. As Off The Grid News previously reported, in October
  699. 2013, FirstEnergy Corp announced that it would shut down
  700. two coal-fired powered plants in Pennsylvania because it
  701. said the cost of complying with EPA regulations was too high.

  703.  Reuters estimated that coal-burning power plants capable
  704. of generating 15,000 megawatts of electricity have shut
  705. down since Obama took office in 2009. The news service
  706. also estimates that power plants that generate around
  707. 37,000 megawatts of power will close in the next 10
  708. years. One megawatt can provide electricity to up to
  709. about 1,000 homes.

  711. Awfully Expensive Electricity
  712.  
  713.  Those plants will be closing at a time when demand for
  714. electricity is increasing. That will force utilities to
  715. build power plants that burn other fuels such as natural
  716. gas. It will add additional cost to electricity rates at
  717. a time when the rates are already going up dramatically.
  718.  
  719.  �It could get awfully expensive,� Daniel Simmons of the
  720. Institute for Energy Research told World Net Daily. �Some
  721. people might see their electricity rates double. If there�s
  722. no backup power plants, that means electricity is going to
  723. get awfully expensive when you have shortages around the
  724. country.

  726. Another Obama Plan To Raise Your Electric Bill

  728.  �We�re talking about dramatically increasing the cost of
  729. electricity all to reduce carbon dioxide emissions. I
  730. think that is the real goal,� Simmons said.

  733. emissions, Carbon Capture and Sequestration, or CSS technology,
  734. could raise electricity costs even more, Simmons predicted.
  735. He noted that a an experimental CSS power plant in the
  736. United States will cost an estimated $4.3 billion to build
  737. and the EPA doesn�t know if the technology would work.

  739.  �The technology is awfully expensive because it hasn�t
  740. been tried anywhere, and that�s to try to capture the
  741. carbon dioxide as it comes out after they burn the coal.�
  742. Simmons said of CSS.

  744.  CSS involves the use of filters to divert carbon emissions
  745. from the air � and every taxpaying American will pay. The
  746. CSS plants under construction will require $300 million in
  747. taxpayer subsidies.

  878. proven technology as there are no commercial-scale
  879. coal plants in the country that uses the technology.
  880. In fact, when the Environmental Protection Agency
  881. wrote its rule limiting coal plant emissions it only
  882. cited CCS projects that were government funded and
  883. not in operation.

  885.  �It is disingenuous to state that the technology is
  886. �ready,�� said Charles McConnell, former assistant
  887. secretary of energy in Obama. �Studies have verified
  888. that implementation of [CSS] technology is necessary
  889. to comply with EPA�s proposed [EPA carbon-emissions
  890. limits] regulation and meet the [greenhouse gas]
  891. targets necessary for limiting CO2 emissions to our

  1081. No one in PG&E/ SCE/ SDG&E areas of California have
  1082. been disconnected solely for refusal to pay �opt out�
  1083. fees, and thousands have been ignoring toothless
  1084. disconnect warnings and deducting the fees from their
  1085. bill every month.  Why are utilities going to such
  1086. lengths to silence critics of their smart meter
  1087. policies?�

  1089.  So-called �smart� meters are not UL approved and have
  1090. never been safety-tested.  But according to grid
  1091. engineering firms such as Raab Associates they are
  1092. part of a technology roadmap which includes �mining
  1093. data for intel� purposes, and �data mining and

  1095. even more troubling is the connection between �smart�
  1096. meters and military R&D funding.

  1983. in the White House�s secret EPA squelch squad. �It�s

  1996. Obama administration) an unfavorable ruling in the case of
  1997. Sackett v. US, but it�s the events leading up to that high
  1998. court hearing that boil the blood of constitutionalists
  1999. and property owners. As reported by William Jasper, senior
  2000. editor of The New American:

  2002.  How long would your bank account hold out if an agency of
  2003. the federal government were fining you $75,000 per day? A
  2004. couple of hours, maybe � or a few minutes? Not many
  2005. homeowners could handle that kind of crushing financial
  2006. blow. Even a Bill Gates, a Warren Buffett, or a George
  2007. Soros might blanch at such astronomical fines.
  2008.  
  2009.  But that was the potential cost facing Idaho couple Mike
  2010. and Chantelle Sackett ... who ran into the iron fist of
  2011. the Environmental Protection Agency (EPA) when they began
  2012. building their home in 2007 on a two-thirds acre parcel in
  2013. a residential neighborhood of Priest Lake. Like their
  2014. neighbors who had already built homes next door, the
  2015. Sacketts got their permits from the county and began
  2016. laying gravel and preparing the ground for building.
  2017. That�s when the EPA came in and, without hearings or
  2018. notice, declared that the property is �wetlands� and
  2019. ordered the Sacketts to restore it to the EPA bureaucracy�s
  2020. satisfaction.
  2021.  
  2022.  The Sacketts, having good reasons to believe their
  2023. property is not a wetlands, were determined to contest
  2024. the EPA order. However, the EPA denied their request for
  2025. a hearing. They sought judicial relief, but the US Ninth
  2026. Circuit Court of Appeals sided with the EPA, ruling that
  2027. the Sacketts had no right to immediate judicial review
  2028. of the matter. The Ninth Circuit held that the couple
  2029. would first have to go through the EPA�s years-long
  2030. wetlands permit process, which would end up costing the
  2031. property owners many times the value of their land!
  2032.  
  2033.  Basically, a group of unelected and unaccountable federal
  2034. officials has shattered the dreams of the Sackett family,
  2035. robbed them of the due process of law guaranteed to every
  2036. citizen by the Constitution, and charged them $75,000 a
  2037. day for the privilege.
  2038.  
  2039.  The Sacketts understood the enormity of the issue raised
  2040. by their pouring of a little gravel on less than an acre
  2041. of land. Said Mrs. Sackett in the days leading up to the
  2042. Supreme Court decision, �The EPA can come in and turn your
  2043. life upside down. They can make you feel really small and
  2044. insignificant. And they take away from you your sense of
  2045. America.�
  2046.  
  2047.  The EPA is not content to obliterate property rights,
  2048. however. Recent actions taken against the country's last
  2049. lead smelting facility will affect the right to keep and
  2050. bear arms, as well, by substantially impacting the production
  2051. of ammunition. On December 31, 2013, the lead refining plant
  2052. closed for good.
  2053.  
  2054.  The St. Louis Post-Dispatch reported just before the
  2055. shuttering of the plant:
  2056.  
  2057.  About 145 employees of the Doe Run lead smelter [in Herculaneum,
  2058. Missouri] learned they will lose their jobs at the end of
  2059. December because of the plant�s closure, the Doe Run Co.
  2060. said Wednesday. An additional 73 contractor jobs also will
  2061. be eliminated.
  2062.  
  2063.  By forcibly closing this plant, the Obama administration
  2064. took yet another unconstitutional step � one that will
  2065. severely impinge on the nation�s ammunition-manufacturing
  2066. capability.
  2067.  
  2068.  Why would the Doe Run Company, the owners of the Missouri
  2069. lead smelting facility, agree to being run out of business
  2070. by the EPA? One word: extortion.
  2071.  
  2072.  In a document published on its website, the EPA explains
  2073. that in order for Doe Run to continue its operations, the
  2074. company would have to agree to pay �$65 million to correct
  2075. violations of several environmental laws at 10 of its lead
  2076. mining, milling and smelting facilities in southeast Missouri.
  2077. The settlement also requires the company to pay a $7 million
  2078. civil penalty.�
  2079.  
  2080.  In a statement to the press, Doe Run said the fine and the
  2081. required upgrades to its facilities were �too financially
  2082. risky.�
  2083.  
  2084.  In cases such as those of the Sacketts, the Doe Run smelting

  2121. Conservation Initiative� made the �entire coast public

  2126.  Khosla �is famous for his backing of bold, eco-friendly
  2127. projects and is a darling of Democratic politicians,� and

  2297. counties to control where and how things are bought and

  2300. details of zoning are excruciatingly complex leaving people
  2301. unable to respond in a timely manner. The enforcement of
  2302. zoning regulations involves heavy fines and/or incarceration.
  2303. In short, zoning has been a terrific way for counties to
  2304. control people�s lives.

  2306.  Such is the story of oyster farmer Anthony Bavuso and his
  2307. family. After years of working corporate and office jobs,
  2308. Bavuso and his wife took a short hiatus from the day-to-day
  2309. drudgery and returned with a new perspective: they wanted to
  2310. become contributors to the economy of raw materials by producing
  2311. something that people needed.
  2312.  
  2313.  Bavuso moved his family back to their home state of Virginia
  2314. with the dream of becoming food producers. Having access to a
  2315. waterfront property, and a background in oyster gardening, it
  2316. made sense to start an oyster farm. Like other types of farming,
  2317. oyster farmers have to manage the growth of their oysters � a
  2318. labor-intensive process requiring a high level of experience.
  2319. An added benefit, for Bavuso, was the knowledge that oysters
  2320. clean the water. As a lifelong Virginian, the health of the
  2321. Chesapeake Bay is never far from his mind. (Oysters eat algae,
  2322. which proliferates in the pollution of the bay, and turn the
  2323. algae into usable protein for humans.)  So the Bavuso family
  2324. started Seaford Oyster Company in Seaford, Virginia.
  2325.  
  2326.  York County maintains a set of zoning ordinances regulating
  2327. various aspects of farming.  There are a list of things that
  2328. are allowed, and if an activity is not on the list, the county
  2329. prohibits it. Penalties include steep fines and possible
  2330. incarceration. Small changes to the zoning ordinances can
  2331. easily disrupt industries and people�s livelihoods.
  2332.  
  2333.  In 2010, Bavuso followed regulatory procedure within his zoning
  2334. district for an oyster farm. He established a lease with the
  2335. Commonwealth of Virginia that gave him the �rights� to the
  2336. section of the bottomland in the Poquoson River adjacent to
  2337. his property. (The bottom lease gives farmers access to
  2338. shellfish only.) Additional regulations and permits involved
  2339. food safety. Wanting to show his interest in producing the
  2340. safest food possible, Bavuso complied with the entire permitting
  2341. process.
  2342.  
  2343.  Prior to starting the farm, the family looked at this list of
  2344. zones and restrictions. In the Bavuso�s zone, farming is �permitted
  2345. by right.� This means for people to farm the land, they need no
  2346. additional land use permits from the county. According to the
  2347. definition of aquaculture in the code, what Bavuso is doing is
  2348. considered part of what is �permitted by right.�
  2349.  
  2350.  By 2011, after more than a year of farming, refining his expertise
  2351. and growing his customer base, Bavuso read in a local newspaper
  2352. that the county was planning on rezoning to remove agriculture
  2353. activities from Bavuso�s �zone.� A �zone� is any area that the
  2354. county designates. Within each zone, the county stipulates what
  2355. particular activities can take place. Once designated, the county
  2356. applies regulations and restrictions. For example, one common
  2357. zoning requirement is that if an area is zoned for residential
  2358. building, there are restrictions and regulations determining
  2359. how from the property line a structure can be built.
  2360.  
  2361.  Bavuso wanted to make sure that he would be grandfathered in and
  2362. that these changes would not affect his farming operation. He
  2363. didn�t know it at the time, but the ordinance was crafted to
  2364. punish a fellow oyster farmer by the name of Greg Garrett. The
  2365. rezoning effort was a actually a political vendetta to punish
  2366. Garrett for supporting a challenger to a currently elected
  2367. member of the York County Board of Supervisors (BOS). Bavuso
  2368. has gotten caught up in that because he does not agree with
  2369. the agenda of the BOS either. And so began what would be at
  2370. least 3 years of limbo for a peaceful man and his family. After
  2371. his vocal opposition, Mr. Bavuso is now is convinced that they
  2372. are attacking him, personally.

  2454.  The proposed standard is 1,100 pounds of CO2 per megawatt
  2455. hour of electricity produced. Today�s most advanced commercial
  2456. coal power plants emit 1,800 pounds of CO2 per megawatt hour.
  2457. New plants could comply only by installing carbon capture and
  2458. storage (CCS) technology � a capability that can add 80% to
  2459. the cost of building a new coal plant.
  2460.  
  2461.  To make the proposal look reasonable, EPA has to bend reality
  2462. a lot. Under section 111(b) of the Clean Air Act, NSPS are to
  2463. reflect the �best system of emission reduction� that has been
  2464. �adequately demonstrated.� EPA claims CCS is adequately
  2465. demonstrated -- but there are no commercial-scale power
  2466. plants operating anywhere with CCS, and none is being built
  2467. without heavy taxpayer and/or consumer subsidies.

  2469.  In short, a utility that builds a new coal plant with CCS,
  2470. as required by EPA�s ruling, risks going bankrupt. The rule
  2471. is thus an informal ban on investment in new coal power

  2567. building a stock pond on their eight-acre farm.

  2569.  Andy and Katie Johnson built the pond in 2012. They stocked it
  2570. with trout, ducks, and geese.
  2571.  
  2572.  Of course, the government is why we can�t have nice things.
  2573. Naturally, the EPA has found a reason to come around and harass
  2574. the Johnsons and prevent them from enjoying their property.
  2575.  
  2576.  Johnson said the EPA has engaged him in a power play and is
  2577. threatening him with massive civil and criminal penalties over
  2578. the pond, which they claim is actually a �dam.�
  2579.

  2584.  The agency claims Johnson violated the Clean Water Act by
  2585. building a dam on a creek without a permit from the Army Corps
  2586. of Engineers. Further, the EPA claims that material from his
  2587. pond is being discharged into other waterways. Johnson says he
  2588. built a stock pond � a man-made pond meant to attract wildlife
  2589. � which is exempt from Clean Water Act regulations.
  2590.  
  2591.  Johnson said that his pond is exempt from the law, and he
  2592. followed state regulations in building it. He has an approval
  2593. etter from the Wyoming State Engineer�s Office as proof, which
  2594. states:
  2595.  
  2596.  �Said permit is in good standing and is entitled to be exercised
  2597. exactly as permitted,� says the letter.
  2598.  
  2599.  The agency is threatening to hit the family with up to $75,000 a
  2600. DAY in fines. Johnson said he�s not paying them a cent:
  2601.  
  2602.  �I have not paid them a dime nor will I. I will go bankrupt if I
  2603. have to fighting it. My wife and I built [the pond] together. We
  2604. put our blood, sweat and tears into it. It was our dream.�
  2605.  
  2606.  Of course, the EPA isn�t backing down. They argue that Johnson
  2607. needs to either restore the land or pay the fines. On January 30,
  2608. the agency gave Johnson 30 days to hire a consultant to assess the
  2609. impact of the supposed unauthorized work and to create a restoration
  2610. proposal. That proposal has to be approved by the EPA, of course,
  2611. and it must contain a schedule. All work would have to be completed
  2612. within 60 days of the plan�s approval.
  2613.  
  2614.  Sounds like they are setting him for failure, doesn�t it? Even if
  2615. he DID violate the law and agreed to make things right, would meeting
  2616. those terms even be possible?
  2617.  
  2618.  If Johnson does not comply with those terms, the EPA is going to
  2619. fine him $37,500 per day in civil penalties, along with $37,500 more
  2620. every day for statutory violations.
  2621.  
  2622.  Johnson is fighting back and has gained the support of three Republican
  2623. senators � John Barrasso and Mike Enzi, who both represent Wyoming �
  2624. and Louisiana Sen. David Vitter, Fox News reports:

  2626.  The Republican lawmakers sent a March 12 letter to Nancy Stoner, the
  2627. EPA�s acting assistant administration for water, saying they were
  2628. �troubled� by Johnson�s case and demanding the EPA withdraw the
  2629. compliance order.
  2630.  
  2631.  �Rather than a sober administration of the Clean Water Act, the
  2632. Compliance Order reads like a draconian edict of a heavy-handed
  2633. bureaucracy,� the letter states.
  2634.  
  2635.  The letter also questions the EPA�s claim that Johnson�s pond is
  2636. actually a dam:
  2637.  
  2638.  �Fairness and due process require the EPA base its compliance order
  2639. on more than an assumption,� they wrote. �Instead of treating Mr.
  2640. Johnson as guilty until he proves his innocence by demonstrating his
  2641. entitlement to the Clean Water Act section 404 (f)(1)(C) stock pond
  2642. exemption, EPA should make its case that a dam was built and that the
  2643. Section 404 exemption does not apply.
  2644.  
  2645.  �If the compliance order stands as an example of how EPA intends
  2646. to operate after completing its current �waters of the United States�
  2647. rule-making, it should give pause to each and every landowner throughout
  2648. the country.�
  2649.  
  2650.  Johnson said his battle with the EPA is serving as a learning
  2651. experience for his children:
  2652.  
  2653.  �This is showing them that they shouldn�t back down. If you need to
  2654. stand up and fight, you do it.
  2655.  
  2656.  �This goes a lot further than a pond. It�s about a person�s rights. I
  2657. have three little kids. I am not going to roll over and let [the government]
  2658. tell me what I can do on my land. I followed the rules.�
  2659.  
  2660.  The infringement on Johnson�s property rights under the veil of
  2661. protecting the environment is bad enough, but some say that the
  2662. astronomical fines are perhaps an even bigger issue � and may even
  2663. be unconstitutional, as Evan Bernick of The Foundry explains:

  2665.  But the eye-popping aspect of this story is the severity of the
  2666. penalties threatened. It�s absurd to threaten someone with tens of
  2667. thousands of dollars in fines because he or she lacks a permit. And
  2668. it might also be unconstitutional.
  2669.  
  2670.  The Framers of our Constitution recognized that, at a certain point,
  2671. penalties become unconstitutionally disproportionate. The Eighth
  2672. Amendment�s Excessive Fines Clause reflects that understanding. In
  2673. Austin v. U.S. (1993), and again in U.S. v. Bajakajian (1998), the
  2674. U.S. Supreme Court explained that �[t]he Excessive Fines Clause
  2675. limits the government�s power to extract payments, whether in cash
  2676. or in kind, as punishment for some offense,� and held that civil
  2677. sanctions that do not serve solely remedial purposes are subject
  2678. to the Excessive Fines Clause. It is impossible to understand the
  2679. threatened fines as serving a purely remedial purpose�surely,
  2680. repairing any damage that Johnson inflicted would cost less than
  2681. $75,000 a day. But, under the terms of the CWA, he is potentially
  2682. subject to such penalties as a consequence of his failure to obtain
  2683. a permit.
  2684.  
  2685.  This is just another sad case of big government stomping all over
  2686. the little guy. Hopefully the EPA won�t get away with destroying the
  2687. Johnsons� hard work and are stopped from sending the family into
  2688. financial ruin.

  2705.  The administrators at the Veterans Administration have
  2706. apparently been busy while old soldiers waited to see a
  2707. doctor, after all. Serving those who served is not necessarily
  2708. a priority, but saving the planet is Job 1. Solar panels and
  2709. windmills can be more important than the touch of a healing
  2710. hand.
  2711.  
  2712.  The department early on set up an Office of Green Management
  2713. Programs designed to �help VA facilities nationwide recognize
  2714. opportunities to green VA, and to reward innovative �green�
  2715. practices and efforts by individual facilities and staff within
  2716. the VA.� This sometimes means paying more attention to greening
  2717. the department and saving the polar ice caps than to health care.
  2718.  
  2719.  In the department�s words, it adopted a far more important
  2720. mission to �become more energy efficient and sustainable, focusing
  2721. primarily on renewable energy, energy and water efficiency,
  2722. [carbon-dioxide] emissions reduction, and sustainable buildings.�
  2723.  
  2724.  The green office isn�t merely a desk and telephone tucked away
  2725. in the dark corner of a nondescript government building. It�s a
  2726. substantial undertaking, with all the luxury, bells and whistles
  2727. of a bureaucracy that means business. Eric K. Shinseki, who
  2728. resigned as secretary in the wake of the VA scandal of the sin
  2729. of omission, traveled the country to boast of the green initiative.
  2730. In one instance, he traveled to Massachusetts to flick the switch
  2731. at a half-million-dollar windmill project at the Massachusetts
  2732. National Cemetery. �Nationally,� he said, �VA continues to expand
  2733. its investment in renewable sources of energy to promote our
  2734. nation�s energy independence, save taxpayer dollars, and improve
  2735. care for our veterans and their families.

  2737.  VA facilities have become littered with every scheme to banish
  2738. carbon dioxide short of requiring visitors to hold their breath.
  2739. Calverton National Cemetery spent $742,034 on solar panels. Fort
  2740. Rosecrans National Cemetery spent $787,308. Not to be out-greened,
  2741. the Riverside National Cemetery spent $1.3 million on its solar
  2742. system.

  2744.  At the Phoenix VA Health Care System, where 20 Americans died from
  2745. incompetence and cover-up, the department spent $20 million putting
  2746. solar panels on the hospital roofs. That would have been more than
  2747. enough money to provide the veterans with the health care they deserved.

  2749.  Some administrators won�t be satisfied until every federal building
  2750. bears a green stamp. In military parlance, the VA is practicing
  2751. �mission creep,� the expansion of a project well beyond its intended
  2752. goals. While the rest of the government continues to waste taxpayer
  2753. funds trying to become carbon-dioxide neutral, the VA should be
  2754. spending every available dollar to relieve pain, cure the sick and
  2755. restore the deserving to health. That�s more important than any fad,
  2756. environmental or otherwise.

  2769. claiming authority to bypass the courts and unilaterally garnish
  2770. paychecks of those accused of violating its rules, a power currently

  2774. collecting more fines each year and hitting individuals with costly
  2775. penalties for violating environmental rules, including recently
  2776. slapping a $75,000 fine on Wyoming homeowner Andy Johnson for
  2777. building a pond on his rural property.

  2779.  �The EPA has a history of overreaching its authority. It seems
  2780. like once again the EPA is trying to take power it doesn�t have
  2781. away from American citizens,� Sen. John Barrasso, Wyoming Republican,
  2782. said when he learned of the EPA�s wage garnishment scheme.

  2784.  Others questioned why the EPA decided to strengthen its collection
  2785. muscle at this time.
  2786.  
  2787.  Critics said the threat of garnishing wages would be a powerful
  2788. incentive for people to agree to expensive settlements rather than
  2789. fight EPA charges.
  2790.  
  2791.  EPA officials did not respond to repeated questions by The Washington
  2792. Times about why they thought it was necessary to garnish people�s wages.
  2793.  
  2794.  The EPA announced the plan last week in a notice in the Federal
  2795. Register, saying federal law allows it �to garnish non-Federal
  2796. wages to collect delinquent non-tax debts owed the United States
  2797. without first obtaining a court order.�
  2798.  
  2799.  The agency cited authority under the Debt Collection Improvement
  2800. Act of 1996 that centralized federal collection operations under
  2801. the Treasury Department, which oversees garnishments of wages or
  2802. tax refund checks.
  2803.  
  2804.  Under the law, every federal agency has the authority to conduct
  2805. administrative wage garnishment, provided the agency adopts
  2806. approved rules for conducting hearings where debtors can challenge
  2807. the amount of debt or terms of repayment schedule, a Treasury
  2808. official said.
  2809.  
  2810.  Still, the rule would give the EPA sweeping authority to dictate
  2811. how and whether Americans could dispute fines and penalties, even
  2812. as the amount of EPA fines collected from individuals, businesses
  2813. and local governments steadily increase.
  2814.  
  2815.  The amount of fines raked in by the agency has jumped from $96
  2816. million in 2009 to $252 million in 2012, a more than 160 percent
  2817. increase, according to EPA annual reports.
  2818.  
  2819.  Putting the collection powers on a fast track, the agency announced
  2820. it in the Federal Register as a �direct final rule� that would take
  2821. effect automatically Sept. 2, unless the EPA receives adverse public
  2822. comments by Aug. 1.
  2823.  
  2824.  The EPA said it deemed the action as not a �significant regulatory
  2825. action� and therefore not subject to review.
  2826.  
  2827. The negative reactions began almost immediately.
  2828.  
  2829.  In a comment letter submitted to the EPA, the conservative Heritage
  2830. Foundation faulted the rule for giving the government �unbridled
  2831. discretion� in controlling the process for challenging fines and
  2832. wage garnishment, such as dictating the site of a hearing without
  2833. consideration of the time and travel expense placed on the accused
  2834. debtor.

  2836.  The rule allows the EPA to decide whether a debtor gets a chance
  2837. to present a defense and then picks whomever it chooses to serve as
  2838. a hearing officer, even someone not trained as an administrative
  2839. law judge, wrote David S. Addington, group vice president for
  2840. research at The Heritage Foundation.

  2842.  It also puts the burden of proof on the debtor, not the EPA,
  2843. he said.

  2845.  The EPA has been on the front lines of the battle over Mr. Obama�s
  2846. climate change agenda, including issuing proposed rules that would
  2847. require coal-fired power plants to cut carbon dioxide emissions by
  2848. 30 percent over 15 years.

  2850.  Critics say it will cause massive increases in the cost of electricity,
  2851. lead to power shortages and eliminate jobs, while making scant impact
  2852. on the amount of greenhouse gasses emitted worldwide.

  2854.  The agency has been a magnet for criticism over new rules on things
  2855. such as wood-burning stoves and small streams or ponds on private
  2856. land, including waterways on farms and golf courses.
