  292. low: Management for Region 8 in Denver, Colo., wrote an email
  293. earlier this year to all staff in the area pleading with them
  294. to stop inappropriate bathroom behavior, including defecating

  307. begged his employees to stop �placing feces in the hallway� and
  308. clogging up toilets with paper towels. While this is, obviously,
  309. a very disgusting matter, the story veers into pretty dumb
  310. territory soon:

  312.  Confounded by what to make of this occurrence, EPA management
  313. �consulted� with workplace violence �national expert� John
  314. Nicoletti, who said that hallway feces is in fact a health and
  315. safety risk. He added the behavior was �very dangerous� and the
  316. individuals responsible would �probably escalate� their actions.
  317.  
  318.  According to his bio, Nicoletti is, indeed, a nationally-recognized
  319. expert on workplace and school violence prevention, with accolades
  320. from the National Science Foundation and numerous chairmanships.
  321. He�s even �a member of NASA�s team for developing analog�s for
  322. training astronauts for long duration missions, such as the
  323. Mars Mission.�

  326. the conclusion that �placing feces in the hallway� is bad, we�ll

  342. out for incandescent light bulbs, which it uses to
  343. provide warmth for injured and recovering birds,
  344. after the federal government banned manufacturers
  345. from making the bulbs.

  347.  In Canada, the more energy-efficient compact
  348. fluorescent light bulbs are considered the norm.
  349. The incandescent light bulbs use more power, but
  350. they are also warmer and serve an important role
  351. inside incubators.
  352.  
  353.  �As the light bulb is on, it will obviously warm
  354. things up and then the setting will turn it off to
  355. keep the right temperature,� explained Mireille
  356. Goguen, who works at the centre.
  357.  
  358.  She said they were caught off-guard by the bulb
  359. ban and they are already running short on
  360. incandescent bulbs. Now they are asking people
  361. to donate 100-watt bulbs.
  362.  
  363.  �(We will take) as many as possible. If people
  364. have them hanging around we will take them or if
  365. they want to buy them for us it would be much
  366. appreciated,� said Goguen.
  367.  
  368.  Donations can be dropped off at the centre,
  369. which is located on Moodie Drive in the city�s
  370. west end.

  378. Wednesday to call on the San Diego City Council to
  379. abandon the plan to remove plastic bags from local
  380. stores.

  382.  Community leaders, including Mark Arabo, president
  383. of the Neighborhood Market Association, held a press
  384. conference in front of Rainbow Market on Federal
  385. Boulevard in which they called the proposed ban a
  386. tax scam that will negatively impact working-class
  387. San Diegans.

  389.  �This is a terrible plan. It�s terrible because
  390. the solution is worse than the so-called problem,�
  391. said Arabo. �It�s a classic case of politicians
  392. attempting to do something for the environment,
  393. in part to appease some environmental groups,
  394. without seeing the bigger picture.�
  395.  
  396.  The proposed ban would remove plastic bags from
  397. stores while imposing a paper bag tax on customers.
  398. Shoppers would be charged 10 cents for each paper
  399. bag they might need at a store.
  400.  
  401.  �This ban will have reaching ramifications. It�ll
  402. cost taxpayers � mothers, fathers and brothers �
  403. more money when they go shopping for groceries,�
  404. said Arabo.
  405.  
  406.  Though the ban is designed to reduce waste and
  407. help the environment, Arabo argued that plastic
  408. bags only make up one-third of one percent of
  409. the waste stream.
  410.  
  411.  On the other end of the plastic bag ban debate,
  412. Sherri Lightner, San Diego City Council President
  413. Pro Tem, District 1, supports the proposed ban.

  420.  The state mandates water-saving toilets and showers
  421. in all homes, but obviously didn�t think long about
  422. how to achieve that.

  424.  First the city of Chico had the ban on nuclear weapons,
  425. then wood-burning stoves, then plastic bags. Now
  426. comes a ban on high-flow toilets. And if you think
  427. the city can�t enforce that, then you haven�t met
  428. the toilet police.
  429.  
  430.  OK, so the title �Toilet Police� probably doesn�t
  431. appear on any city worker�s business card, but
  432. that�s what they are.
  433.  
  434.  But let�s not blame city building inspectors for
  435. an odd law � or even the Chico City Council. For
  436. once, this ridiculous save-the-world concept doesn�t
  437. come from the council, but rather from the busybodies
  438. in the state Legislature. They passed a law that took
  439. effect Jan. 1 that requires water-conserving plumbing
  440. fixtures on any home built before 1994.
  441.  
  442.  How will that be enforced? Well, if a property has
  443. any work done that requires a building permit from
  444. a city or county, that entity�s inspector must verify
  445. that the home has low-flow toilets, showers and faucets.
  446.  
  447.  To make it even more disturbing, the low-flow
  448. inspection doesn�t occur if you�re getting plumbing
  449. work. It occurs if you�re getting any work that requires
  450. a building permit, such as getting a new heater, new
  451. windows or converting a garage into a den. Uh, maybe.
  452.  
  453.  So under the letter of the law, if a homeowner buys
  454. a new water heater or fireplace insert for a couple
  455. hundred dollars, he or she might spend considerably
  456. more than that converting all toilets, faucets and
  457. showerheads to low-flow devices.
  458.  
  459.  City and county building inspectors don�t want to be
  460. toilet police. We can�t imagine them wanting to spend
  461. time checking a person�s toilet when they�re there
  462. to check an air conditioner. They�re taking a loose
  463. interpretation of the law for now, and won�t inspect
  464. toilets during projects like repairs and maintenance
  465. that don�t involve plumbing.
  466.  
  467.  But there�s no guarantee the state, which passed
  468. the law, won�t require cities and counties to enforce
  469. a strict interpretation.
  470.  
  471.  With all the uncertainty, it entices a homeowner to
  472. ignore the government requirement to get a building
  473. permit for minor home improvement projects.
  474.  
  475.  Governments should be concerned if fewer people take
  476. out building permits. It means less revenue for
  477. cash-strapped local governments.
  478.

  560. Authority unprecedented powers.�

  563. most oppressive government policies. Since the
  564. SCOTUS� decision in Kelo v. City of New London,
  565. eminent domain continues to be the enemy of property

  568. their land than they originally paid for it. Businesses

  604. set in motion in 2007 by Congress, and later by an
  605. Executive Order issued by President Obama in May of
  606. last year. The regulations will apply to medium and
  607. heavy-duty trucks built in 2014 through 2018, aimed
  608. at reducing annual national fuel consumption by 530
  609. million barrels.

  611.  The new regulations will be aimed at one of three
  612. specific subsets of trucks: combination tractors
  613. (commonly referred to as semi-trucks), heavy-duty

  666. rates would necessarily skyrocket,� Obama told the editorial
  667. board of The San Francisco Chronicle in 2008. �Even
  668. regardless of what I say about whether coal is good or
  669. bad. Because I�m capping greenhouse gases, coal power
  670. plants, you know, natural gas, you name it � whatever
  671. the plants were, whatever the industry was, they would
  672. have to, retrofit their operations. That will cost money.
  673. They will pass that money on to consumers.�

  675.  �So if somebody wants to build a coal-powered plant,
  676. they can; it�s just that it will bankrupt them,� Obama
  677. said, �because they�re going to be charged a huge sum for
  678. all that greenhouse gas that�s being emitted.�

  680.  Obama�s prediction about coal plants have been proven
  681. true. As Off The Grid News previously reported, in October
  682. 2013, FirstEnergy Corp announced that it would shut down
  683. two coal-fired powered plants in Pennsylvania because it
  684. said the cost of complying with EPA regulations was too high.
  685.  
  686.  Reuters estimated that coal-burning power plants capable
  687. of generating 15,000 megawatts of electricity have shut
  688. down since Obama took office in 2009. The news service
  689. also estimates that power plants that generate around
  690. 37,000 megawatts of power will close in the next 10
  691. years. One megawatt can provide electricity to up to
  692. about 1,000 homes.

  694. Awfully Expensive Electricity
  695.  
  696.  Those plants will be closing at a time when demand for
  697. electricity is increasing. That will force utilities to
  698. build power plants that burn other fuels such as natural
  699. gas. It will add additional cost to electricity rates at
  700. a time when the rates are already going up dramatically.
  701.  
  702.  �It could get awfully expensive,� Daniel Simmons of the
  703. Institute for Energy Research told World Net Daily. �Some
  704. people might see their electricity rates double. If there�s
  705. no backup power plants, that means electricity is going to
  706. get awfully expensive when you have shortages around the
  707. country.

  709. Another Obama Plan To Raise Your Electric Bill

  711.  �We�re talking about dramatically increasing the cost of
  712. electricity all to reduce carbon dioxide emissions. I
  713. think that is the real goal,� Simmons said.

  715.  Another Obama administration plan to reduce greenhouse
  716. emissions, Carbon Capture and Sequestration, or CSS technology,
  717. could raise electricity costs even more, Simmons predicted.
  718. He noted that a an experimental CSS power plant in the
  719. United States will cost an estimated $4.3 billion to build
  720. and the EPA doesn�t know if the technology would work.

  722.  �The technology is awfully expensive because it hasn�t
  723. been tried anywhere, and that�s to try to capture the
  724. carbon dioxide as it comes out after they burn the coal.�
  725. Simmons said of CSS.

  727.  CSS involves the use of filters to divert carbon emissions
  728. from the air � and every taxpaying American will pay. The
  729. CSS plants under construction will require $300 million in
  730. taxpayer subsidies.

  862. coal plants in the country that uses the technology.
  863. In fact, when the Environmental Protection Agency
  864. wrote its rule limiting coal plant emissions it only
  865. cited CCS projects that were government funded and
  866. not in operation.

  868.  �It is disingenuous to state that the technology is
  869. �ready,�� said Charles McConnell, former assistant
  870. secretary of energy in Obama. �Studies have verified
  871. that implementation of [CSS] technology is necessary
  872. to comply with EPA�s proposed [EPA carbon-emissions
  873. limits] regulation and meet the [greenhouse gas]
  874. targets necessary for limiting CO2 emissions to our
  875. atmosphere.�

  1516. Georgia Tech campus toward the environmental �science�
  1517. department. I�m sure that much of what was studied by
  1518. environmental science majors was legitimate, especially
  1519. as it concerned local phenomena and processes. But
  1520. when it comes to the global aspects of environmental
  1521. science (weather systems, causation, the long-term
  1522. effects of pollution, etc.), it becomes obvious that
  1523. environmental scientists are less reliable than
  1524. weathermen and relying heavily on extremely speculative
  1525. models of explanation.

  1527.  Pollution is defined by concentrations. Nothing that
  1528. is considered a pollutant is necessarily bad intrinsically
  1529. or necessarily. Even toxic elements occur naturally at
  1530. low concentrations. The EPA determines what those
  1531. concentrations are allowed to be in order to still
  1532. be considered �safe.� And recently, the EPA has been
  1533. narrowing those regulations even further, most recently
  1534. in an attempt to force businesses to �go green.� But

  1537. as �hard science� that is impossible to reproduce

  1980. Sackett v. US, but it�s the events leading up to that high

  1986. the federal government were fining you $75,000 per day? A
  1987. couple of hours, maybe � or a few minutes? Not many
  1988. homeowners could handle that kind of crushing financial
  1989. blow. Even a Bill Gates, a Warren Buffett, or a George
  1990. Soros might blanch at such astronomical fines.
  1991.  
  1992.  But that was the potential cost facing Idaho couple Mike
  1993. and Chantelle Sackett ... who ran into the iron fist of
  1994. the Environmental Protection Agency (EPA) when they began
  1995. building their home in 2007 on a two-thirds acre parcel in
  1996. a residential neighborhood of Priest Lake. Like their
  1997. neighbors who had already built homes next door, the
  1998. Sacketts got their permits from the county and began
  1999. laying gravel and preparing the ground for building.
  2000. That�s when the EPA came in and, without hearings or
  2001. notice, declared that the property is �wetlands� and
  2002. ordered the Sacketts to restore it to the EPA bureaucracy�s
  2003. satisfaction.
  2004.  
  2005.  The Sacketts, having good reasons to believe their
  2006. property is not a wetlands, were determined to contest
  2007. the EPA order. However, the EPA denied their request for
  2008. a hearing. They sought judicial relief, but the US Ninth
  2009. Circuit Court of Appeals sided with the EPA, ruling that
  2010. the Sacketts had no right to immediate judicial review
  2011. of the matter. The Ninth Circuit held that the couple
  2012. would first have to go through the EPA�s years-long
  2013. wetlands permit process, which would end up costing the
  2014. property owners many times the value of their land!
  2015.  
  2016.  Basically, a group of unelected and unaccountable federal
  2017. officials has shattered the dreams of the Sackett family,
  2018. robbed them of the due process of law guaranteed to every
  2019. citizen by the Constitution, and charged them $75,000 a
  2020. day for the privilege.
  2021.  
  2022.  The Sacketts understood the enormity of the issue raised
  2023. by their pouring of a little gravel on less than an acre
  2024. of land. Said Mrs. Sackett in the days leading up to the
  2025. Supreme Court decision, �The EPA can come in and turn your
  2026. life upside down. They can make you feel really small and
  2027. insignificant. And they take away from you your sense of
  2028. America.�
  2029.  
  2030.  The EPA is not content to obliterate property rights,
  2031. however. Recent actions taken against the country's last
  2032. lead smelting facility will affect the right to keep and
  2033. bear arms, as well, by substantially impacting the production
  2034. of ammunition. On December 31, 2013, the lead refining plant
  2035. closed for good.
  2036.  
  2037.  The St. Louis Post-Dispatch reported just before the
  2038. shuttering of the plant:

  2040.  About 145 employees of the Doe Run lead smelter [in Herculaneum,
  2041. Missouri] learned they will lose their jobs at the end of
  2042. December because of the plant�s closure, the Doe Run Co.
  2043. said Wednesday. An additional 73 contractor jobs also will
  2044. be eliminated.
  2045.  
  2046.  By forcibly closing this plant, the Obama administration
  2047. took yet another unconstitutional step � one that will
  2048. severely impinge on the nation�s ammunition-manufacturing
  2049. capability.
  2050.  
  2051.  Why would the Doe Run Company, the owners of the Missouri
  2052. lead smelting facility, agree to being run out of business
  2053. by the EPA? One word: extortion.
  2054.  
  2055.  In a document published on its website, the EPA explains
  2056. that in order for Doe Run to continue its operations, the
  2057. company would have to agree to pay �$65 million to correct
  2058. violations of several environmental laws at 10 of its lead
  2059. mining, milling and smelting facilities in southeast Missouri.
  2060. The settlement also requires the company to pay a $7 million
  2061. civil penalty.�
  2062.  
  2063.  In a statement to the press, Doe Run said the fine and the
  2064. required upgrades to its facilities were �too financially
  2065. risky.�
  2066.  
  2067.  In cases such as those of the Sacketts, the Doe Run smelting
  2068. facility, and scores of others nationwide, the EPA�s heavy
  2069. handed, unconstitutional tactics should have been investigated
  2070. and the nearly unbounded power should have been reined in.

  2072.  They carried on without oversight, however, and perhaps
  2073. now we know why.

  2097. �Surfrider, in this lawsuit, is asking to protect an
  2098. access right that simply doesn�t exist.� But they were
  2099. denied their motion to prevent Khosla from testifying in
  2100. the matter, and Khosla will have to do so on Monday as
  2101. the trial resumes.
  2102.  
  2103.  As the Chronicle noted, a 1972 �California Coastal Zone
  2104. Conservation Initiative� made the �entire coast public
  2105. property, including beaches below the mean high tide,�
  2106. and the lawsuit presents the biggest challenge to that
  2107. initiative.
  2108.  
  2109.  Khosla �is famous for his backing of bold, eco-friendly
  2110. projects and is a darling of Democratic politicians,� and
  2111. is company paid �$37.5 million for the property, which
  2112. includes 45 leased cabins along the coastal cliffs.�

  2114.  Surfrider is claiming that since the �closed gate means
  2115. the only way people can get there is from the ocean,�
  2116. Khosla is in violation of the �public access provisions
  2117. in the coastal act.�

  2119.  Lawyers for Martins Beach have also weighed in, saying the
  2120. previous historic $5 �beach fees prove that the public never
  2121. had a right to access that beach.�

  2257. counties to control where and how things are bought and

  2260. details of zoning are excruciatingly complex leaving people
  2261. unable to respond in a timely manner. The enforcement of
  2262. zoning regulations involves heavy fines and/or incarceration.
  2263. In short, zoning has been a terrific way for counties to
  2264. control people�s lives.

  2266.  Such is the story of oyster farmer Anthony Bavuso and his
  2267. family. After years of working corporate and office jobs,
  2268. Bavuso and his wife took a short hiatus from the day-to-day
  2269. drudgery and returned with a new perspective: they wanted to
  2270. become contributors to the economy of raw materials by producing
  2271. something that people needed.
  2272.  
  2273.  Bavuso moved his family back to their home state of Virginia
  2274. with the dream of becoming food producers. Having access to a
  2275. waterfront property, and a background in oyster gardening, it
  2276. made sense to start an oyster farm. Like other types of farming,
  2277. oyster farmers have to manage the growth of their oysters � a
  2278. labor-intensive process requiring a high level of experience.
  2279. An added benefit, for Bavuso, was the knowledge that oysters
  2280. clean the water. As a lifelong Virginian, the health of the
  2281. Chesapeake Bay is never far from his mind. (Oysters eat algae,
  2282. which proliferates in the pollution of the bay, and turn the
  2283. algae into usable protein for humans.)  So the Bavuso family
  2284. started Seaford Oyster Company in Seaford, Virginia.
  2285.  
  2286.  York County maintains a set of zoning ordinances regulating
  2287. various aspects of farming.  There are a list of things that
  2288. are allowed, and if an activity is not on the list, the county
  2289. prohibits it. Penalties include steep fines and possible
  2290. incarceration. Small changes to the zoning ordinances can
  2291. easily disrupt industries and people�s livelihoods.
  2292.  
  2293.  In 2010, Bavuso followed regulatory procedure within his zoning
  2294. district for an oyster farm. He established a lease with the
  2295. Commonwealth of Virginia that gave him the �rights� to the
  2296. section of the bottomland in the Poquoson River adjacent to
  2297. his property. (The bottom lease gives farmers access to
  2298. shellfish only.) Additional regulations and permits involved
  2299. food safety. Wanting to show his interest in producing the
  2300. safest food possible, Bavuso complied with the entire permitting
  2301. process.
  2302.  
  2303.  Prior to starting the farm, the family looked at this list of
  2304. zones and restrictions. In the Bavuso�s zone, farming is �permitted
  2305. by right.� This means for people to farm the land, they need no
  2306. additional land use permits from the county. According to the
  2307. definition of aquaculture in the code, what Bavuso is doing is
  2308. considered part of what is �permitted by right.�
  2309.  
  2310.  By 2011, after more than a year of farming, refining his expertise
  2311. and growing his customer base, Bavuso read in a local newspaper
  2312. that the county was planning on rezoning to remove agriculture
  2313. activities from Bavuso�s �zone.� A �zone� is any area that the
  2314. county designates. Within each zone, the county stipulates what
  2315. particular activities can take place. Once designated, the county
  2316. applies regulations and restrictions. For example, one common
  2317. zoning requirement is that if an area is zoned for residential
  2318. building, there are restrictions and regulations determining
  2319. how from the property line a structure can be built.
  2320.  
  2321.  Bavuso wanted to make sure that he would be grandfathered in and
  2322. that these changes would not affect his farming operation. He
  2323. didn�t know it at the time, but the ordinance was crafted to
  2324. punish a fellow oyster farmer by the name of Greg Garrett. The
  2325. rezoning effort was a actually a political vendetta to punish
  2326. Garrett for supporting a challenger to a currently elected
  2327. member of the York County Board of Supervisors (BOS). Bavuso
  2328. has gotten caught up in that because he does not agree with
  2329. the agenda of the BOS either. And so began what would be at
  2330. least 3 years of limbo for a peaceful man and his family. After
  2331. his vocal opposition, Mr. Bavuso is now is convinced that they
  2332. are attacking him, personally.

  2414.  The proposed standard is 1,100 pounds of CO2 per megawatt
  2415. hour of electricity produced. Today�s most advanced commercial
  2416. coal power plants emit 1,800 pounds of CO2 per megawatt hour.
  2417. New plants could comply only by installing carbon capture and
  2418. storage (CCS) technology � a capability that can add 80% to
  2419. the cost of building a new coal plant.
  2420.  
  2421.  To make the proposal look reasonable, EPA has to bend reality
  2422. a lot. Under section 111(b) of the Clean Air Act, NSPS are to
  2423. reflect the �best system of emission reduction� that has been
  2424. �adequately demonstrated.� EPA claims CCS is adequately
  2425. demonstrated -- but there are no commercial-scale power
  2426. plants operating anywhere with CCS, and none is being built
  2427. without heavy taxpayer and/or consumer subsidies.

  2429.  In short, a utility that builds a new coal plant with CCS,
  2430. as required by EPA�s ruling, risks going bankrupt. The rule
  2431. is thus an informal ban on investment in new coal power
  2432. generation.

  2481. apesticide that has been banned in the European Union
  2482. because it is considered a threat to bees. A letter from
  2483. the Center to the Environmental Protection Agency raises
  2484. some serious concerns about thiamethoxam and another
  2485. pesticide, sulfoxaflor.

  2557. exactly as permitted,� says the letter.

  2559.  The agency is threatening to hit the family with up to $75,000 a

  2568. the agency gave Johnson 30 days to hire a consultant to assess the
  2569. impact of the supposed unauthorized work and to create a restoration
  2570. proposal. That proposal has to be approved by the EPA, of course,
  2571. and it must contain a schedule. All work would have to be completed
  2572. within 60 days of the plan�s approval.
  2573.  
  2574.  Sounds like they are setting him for failure, doesn�t it? Even if
  2575. he DID violate the law and agreed to make things right, would meeting
  2576. those terms even be possible?
  2577.  
  2578.  If Johnson does not comply with those terms, the EPA is going to
  2579. fine him $37,500 per day in civil penalties, along with $37,500 more
  2580. every day for statutory violations.
  2581.  
  2582.  Johnson is fighting back and has gained the support of three Republican
  2583. senators � John Barrasso and Mike Enzi, who both represent Wyoming �
  2584. and Louisiana Sen. David Vitter, Fox News reports:
  2585.  
  2586.  The Republican lawmakers sent a March 12 letter to Nancy Stoner, the
  2587. EPA�s acting assistant administration for water, saying they were
  2588. �troubled� by Johnson�s case and demanding the EPA withdraw the
  2589. compliance order.
  2590.  
  2591.  �Rather than a sober administration of the Clean Water Act, the
  2592. Compliance Order reads like a draconian edict of a heavy-handed
  2593. bureaucracy,� the letter states.
  2594.  
  2595.  The letter also questions the EPA�s claim that Johnson�s pond is
  2596. actually a dam:
  2597.  
  2598.  �Fairness and due process require the EPA base its compliance order
  2599. on more than an assumption,� they wrote. �Instead of treating Mr.
  2600. Johnson as guilty until he proves his innocence by demonstrating his
  2601. entitlement to the Clean Water Act section 404 (f)(1)(C) stock pond
  2602. exemption, EPA should make its case that a dam was built and that the
  2603. Section 404 exemption does not apply.
  2604.  
  2605.  �If the compliance order stands as an example of how EPA intends
  2606. to operate after completing its current �waters of the United States�
  2607. rule-making, it should give pause to each and every landowner throughout
  2608. the country.�
  2609.  
  2610.  Johnson said his battle with the EPA is serving as a learning
  2611. experience for his children:
  2612.  
  2613.  �This is showing them that they shouldn�t back down. If you need to
  2614. stand up and fight, you do it.
  2615.  
  2616.  �This goes a lot further than a pond. It�s about a person�s rights. I
  2617. have three little kids. I am not going to roll over and let [the government]
  2618. tell me what I can do on my land. I followed the rules.�
  2619.  
  2620.  The infringement on Johnson�s property rights under the veil of
  2621. protecting the environment is bad enough, but some say that the
  2622. astronomical fines are perhaps an even bigger issue � and may even
  2623. be unconstitutional, as Evan Bernick of The Foundry explains:

  2625.  But the eye-popping aspect of this story is the severity of the
  2626. penalties threatened. It�s absurd to threaten someone with tens of
  2627. thousands of dollars in fines because he or she lacks a permit. And
  2628. it might also be unconstitutional.
  2629.  
  2630.  The Framers of our Constitution recognized that, at a certain point,
  2631. penalties become unconstitutionally disproportionate. The Eighth
  2632. Amendment�s Excessive Fines Clause reflects that understanding. In
  2633. Austin v. U.S. (1993), and again in U.S. v. Bajakajian (1998), the
  2634. U.S. Supreme Court explained that �[t]he Excessive Fines Clause
  2635. limits the government�s power to extract payments, whether in cash
  2636. or in kind, as punishment for some offense,� and held that civil
  2637. sanctions that do not serve solely remedial purposes are subject
  2638. to the Excessive Fines Clause. It is impossible to understand the
  2639. threatened fines as serving a purely remedial purpose�surely,
  2640. repairing any damage that Johnson inflicted would cost less than
  2641. $75,000 a day. But, under the terms of the CWA, he is potentially
  2642. subject to such penalties as a consequence of his failure to obtain
  2643. a permit.

  2645.  This is just another sad case of big government stomping all over
  2646. the little guy. Hopefully the EPA won�t get away with destroying the
  2647. Johnsons� hard work and are stopped from sending the family into
  2648. financial ruin.

  2665.  The administrators at the Veterans Administration have
  2666. apparently been busy while old soldiers waited to see a
  2667. doctor, after all. Serving those who served is not necessarily
  2668. a priority, but saving the planet is Job 1. Solar panels and
  2669. windmills can be more important than the touch of a healing
  2670. hand.
  2671.  
  2672.  The department early on set up an Office of Green Management
  2673. Programs designed to �help VA facilities nationwide recognize
  2674. opportunities to green VA, and to reward innovative �green�
  2675. practices and efforts by individual facilities and staff within
  2676. the VA.� This sometimes means paying more attention to greening
  2677. the department and saving the polar ice caps than to health care.
  2678.  
  2679.  In the department�s words, it adopted a far more important
  2680. mission to �become more energy efficient and sustainable, focusing
  2681. primarily on renewable energy, energy and water efficiency,
  2682. [carbon-dioxide] emissions reduction, and sustainable buildings.�
  2683.  
  2684.  The green office isn�t merely a desk and telephone tucked away
  2685. in the dark corner of a nondescript government building. It�s a
  2686. substantial undertaking, with all the luxury, bells and whistles
  2687. of a bureaucracy that means business. Eric K. Shinseki, who
  2688. resigned as secretary in the wake of the VA scandal of the sin
  2689. of omission, traveled the country to boast of the green initiative.
  2690. In one instance, he traveled to Massachusetts to flick the switch
  2691. at a half-million-dollar windmill project at the Massachusetts
  2692. National Cemetery. �Nationally,� he said, �VA continues to expand
  2693. its investment in renewable sources of energy to promote our
  2694. nation�s energy independence, save taxpayer dollars, and improve
  2695. care for our veterans and their families.
  2696.  
  2697.  VA facilities have become littered with every scheme to banish
  2698. carbon dioxide short of requiring visitors to hold their breath.
  2699. Calverton National Cemetery spent $742,034 on solar panels. Fort
  2700. Rosecrans National Cemetery spent $787,308. Not to be out-greened,
  2701. the Riverside National Cemetery spent $1.3 million on its solar
  2702. system.

  2704.  At the Phoenix VA Health Care System, where 20 Americans died from
  2705. incompetence and cover-up, the department spent $20 million putting
  2706. solar panels on the hospital roofs. That would have been more than
  2707. enough money to provide the veterans with the health care they deserved.

  2709.  Some administrators won�t be satisfied until every federal building
  2710. bears a green stamp. In military parlance, the VA is practicing
  2711. �mission creep,� the expansion of a project well beyond its intended
  2712. goals. While the rest of the government continues to waste taxpayer
  2713. funds trying to become carbon-dioxide neutral, the VA should be
  2714. spending every available dollar to relieve pain, cure the sick and
  2715. restore the deserving to health. That�s more important than any fad,
  2716. environmental or otherwise.

  2725.  The Environmental Protection Agency has quietly floated a rule
  2726. claiming authority to bypass the courts and unilaterally garnish
  2727. paychecks of those accused of violating its rules, a power currently
  2728. used by agencies such as the Internal Revenue Service.

  2730.  The EPA has been flexing its regulatory muscle under dictator Obama,
  2731. collecting more fines each year and hitting individuals with costly
  2732. penalties for violating environmental rules, including recently
  2733. slapping a $75,000 fine on Wyoming homeowner Andy Johnson for
  2734. building a pond on his rural property.
  2735.  
  2736.  �The EPA has a history of overreaching its authority. It seems
  2737. like once again the EPA is trying to take power it doesn�t have
  2738. away from American citizens,� Sen. John Barrasso, Wyoming Republican,
  2739. said when he learned of the EPA�s wage garnishment scheme.
  2740.  
  2741.  Others questioned why the EPA decided to strengthen its collection
  2742. muscle at this time.
  2743.  
  2744.  Critics said the threat of garnishing wages would be a powerful
  2745. incentive for people to agree to expensive settlements rather than
  2746. fight EPA charges.
  2747.  
  2748.  EPA officials did not respond to repeated questions by The Washington
  2749. Times about why they thought it was necessary to garnish people�s wages.
  2750.  
  2751.  The EPA announced the plan last week in a notice in the Federal
  2752. Register, saying federal law allows it �to garnish non-Federal
  2753. wages to collect delinquent non-tax debts owed the United States
  2754. without first obtaining a court order.�
  2755.  
  2756.  The agency cited authority under the Debt Collection Improvement
  2757. Act of 1996 that centralized federal collection operations under
  2758. the Treasury Department, which oversees garnishments of wages or
  2759. tax refund checks.
  2760.  
  2761.  Under the law, every federal agency has the authority to conduct
  2762. administrative wage garnishment, provided the agency adopts
  2763. approved rules for conducting hearings where debtors can challenge
  2764. the amount of debt or terms of repayment schedule, a Treasury
  2765. official said.
  2766.  
  2767.  Still, the rule would give the EPA sweeping authority to dictate
  2768. how and whether Americans could dispute fines and penalties, even
  2769. as the amount of EPA fines collected from individuals, businesses
  2770. and local governments steadily increase.
  2771.  
  2772.  The amount of fines raked in by the agency has jumped from $96
  2773. million in 2009 to $252 million in 2012, a more than 160 percent
  2774. increase, according to EPA annual reports.
  2775.  
  2776.  Putting the collection powers on a fast track, the agency announced
  2777. it in the Federal Register as a �direct final rule� that would take
  2778. effect automatically Sept. 2, unless the EPA receives adverse public
  2779. comments by Aug. 1.
  2780.  
  2781.  The EPA said it deemed the action as not a �significant regulatory
  2782. action� and therefore not subject to review.
  2783.  
  2784. The negative reactions began almost immediately.
  2785.  
  2786.  In a comment letter submitted to the EPA, the conservative Heritage
  2787. Foundation faulted the rule for giving the government �unbridled
  2788. discretion� in controlling the process for challenging fines and
  2789. wage garnishment, such as dictating the site of a hearing without
  2790. consideration of the time and travel expense placed on the accused
  2791. debtor.

  2793.  The rule allows the EPA to decide whether a debtor gets a chance
  2794. to present a defense and then picks whomever it chooses to serve as
  2795. a hearing officer, even someone not trained as an administrative
  2796. law judge, wrote David S. Addington, group vice president for
  2797. research at The Heritage Foundation.
  2798.  
  2799.  It also puts the burden of proof on the debtor, not the EPA,
  2800. he said.

  2802.  The EPA has been on the front lines of the battle over Mr. Obama�s
  2803. climate change agenda, including issuing proposed rules that would
  2804. require coal-fired power plants to cut carbon dioxide emissions by
  2805. 30 percent over 15 years.

  2807.  Critics say it will cause massive increases in the cost of electricity,
  2808. lead to power shortages and eliminate jobs, while making scant impact
  2809. on the amount of greenhouse gasses emitted worldwide.
  2810.  
  2811.  The agency has been a magnet for criticism over new rules on things
  2812. such as wood-burning stoves and small streams or ponds on private
  2813. land, including waterways on farms and golf courses.
  2814.  
  2815.  Due Process? Trial by Jury? Innocent until proven guilty?
