  301. fluorescent light bulbs are considered the norm.
  302. The incandescent light bulbs use more power, but
  303. they are also warmer and serve an important role
  304. inside incubators.

  306.  �As the light bulb is on, it will obviously warm
  307. things up and then the setting will turn it off to
  308. keep the right temperature,� explained Mireille
  309. Goguen, who works at the centre.

  311.  She said they were caught off-guard by the bulb
  312. ban and they are already running short on
  313. incandescent bulbs. Now they are asking people
  314. to donate 100-watt bulbs.
  315.  
  316.  �(We will take) as many as possible. If people
  317. have them hanging around we will take them or if
  318. they want to buy them for us it would be much
  319. appreciated,� said Goguen.

  321.  Donations can be dropped off at the centre,
  322. which is located on Moodie Drive in the city�s

  331. Wednesday to call on the San Diego City Council to
  332. abandon the plan to remove plastic bags from local
  333. stores.

  335.  Community leaders, including Mark Arabo, president
  336. of the Neighborhood Market Association, held a press
  337. conference in front of Rainbow Market on Federal
  338. Boulevard in which they called the proposed ban a
  339. tax scam that will negatively impact working-class
  340. San Diegans.

  342.  �This is a terrible plan. It�s terrible because
  343. the solution is worse than the so-called problem,�
  344. said Arabo. �It�s a classic case of politicians
  345. attempting to do something for the environment,
  346. in part to appease some environmental groups,
  347. without seeing the bigger picture.�

  349.  The proposed ban would remove plastic bags from
  350. stores while imposing a paper bag tax on customers.
  351. Shoppers would be charged 10 cents for each paper
  352. bag they might need at a store.
  353.  
  354.  �This ban will have reaching ramifications. It�ll
  355. cost taxpayers � mothers, fathers and brothers �
  356. more money when they go shopping for groceries,�
  357. said Arabo.
  358.  
  359.  Though the ban is designed to reduce waste and
  360. help the environment, Arabo argued that plastic
  361. bags only make up one-third of one percent of
  362. the waste stream.

  364.  On the other end of the plastic bag ban debate,
  365. Sherri Lightner, San Diego City Council President
  366. Pro Tem, District 1, supports the proposed ban.

  373.  The state mandates water-saving toilets and showers
  374. in all homes, but obviously didn�t think long about
  375. how to achieve that.

  377.  First the city of Chico had the ban on nuclear weapons,
  378. then wood-burning stoves, then plastic bags. Now
  379. comes a ban on high-flow toilets. And if you think
  380. the city can�t enforce that, then you haven�t met
  381. the toilet police.
  382.  
  383.  OK, so the title �Toilet Police� probably doesn�t
  384. appear on any city worker�s business card, but
  385. that�s what they are.
  386.  
  387.  But let�s not blame city building inspectors for
  388. an odd law � or even the Chico City Council. For
  389. once, this ridiculous save-the-world concept doesn�t
  390. come from the council, but rather from the busybodies
  391. in the state Legislature. They passed a law that took
  392. effect Jan. 1 that requires water-conserving plumbing
  393. fixtures on any home built before 1994.
  394.  
  395.  How will that be enforced? Well, if a property has
  396. any work done that requires a building permit from
  397. a city or county, that entity�s inspector must verify
  398. that the home has low-flow toilets, showers and faucets.
  399.  
  400.  To make it even more disturbing, the low-flow
  401. inspection doesn�t occur if you�re getting plumbing
  402. work. It occurs if you�re getting any work that requires
  403. a building permit, such as getting a new heater, new
  404. windows or converting a garage into a den. Uh, maybe.
  405.  
  406.  So under the letter of the law, if a homeowner buys
  407. a new water heater or fireplace insert for a couple
  408. hundred dollars, he or she might spend considerably
  409. more than that converting all toilets, faucets and
  410. showerheads to low-flow devices.
  411.  
  412.  City and county building inspectors don�t want to be
  413. toilet police. We can�t imagine them wanting to spend
  414. time checking a person�s toilet when they�re there
  415. to check an air conditioner. They�re taking a loose
  416. interpretation of the law for now, and won�t inspect
  417. toilets during projects like repairs and maintenance
  418. that don�t involve plumbing.
  419.  
  420.  But there�s no guarantee the state, which passed
  421. the law, won�t require cities and counties to enforce
  422. a strict interpretation.
  423.  
  424.  With all the uncertainty, it entices a homeowner to
  425. ignore the government requirement to get a building
  426. permit for minor home improvement projects.
  427.  
  428.  Governments should be concerned if fewer people take
  429. out building permits. It means less revenue for
  430. cash-strapped local governments.
  431.  
  432.  The building industry is concerned that residents
  433. may put off rebuilding and home improvement projects
  434. because they would include this unwanted expense.
  435. With the building industry and contractors finally
  436. showing signs of recovery from the recession, we
  437. don�t want to see new obstacles.
  438.  
  439.  Once again the state passes a goofy law without
  440. thinking about the consequences, since somebody else
  441. has to enforce it. The city and county building
  442. departments urge residents not to be scared off by
  443. the new laws, to call and ask questions. It seems
  444. they are like the rest of us, trying to figure out
  445. how long they can ignore the fools in Sacramento
  446. before they get caught.

  553. for medium- and heavy-duty trucks regarding both fuel

  556.  The new standards are the result of a mandate first
  557. set in motion in 2007 by Congress, and later by an
  558. Executive Order issued by President Obama in May of
  559. last year. The regulations will apply to medium and
  560. heavy-duty trucks built in 2014 through 2018, aimed
  561. at reducing annual national fuel consumption by 530
  562. million barrels.

  564.  The new regulations will be aimed at one of three
  565. specific subsets of trucks: combination tractors
  566. (commonly referred to as semi-trucks), heavy-duty
  567. pickup trucks and vans and vocational vehicles.

  569.  Each category will have its own regulations, but
  570. the end goal is to reduce fuel consumption by as
  571. much as 20 percent by 2018, which is the case for

  612. Obama Admitted Plan Would Raise Electricity Rates

  614.  There is some evidence that President Obama has a
  615. deliberate strategy of increasing electricity rates and
  616. destroying the coal industry.

  618.  �Under my plan of a cap-and-trade system, electricity
  619. rates would necessarily skyrocket,� Obama told the editorial
  620. board of The San Francisco Chronicle in 2008. �Even
  621. regardless of what I say about whether coal is good or
  622. bad. Because I�m capping greenhouse gases, coal power
  623. plants, you know, natural gas, you name it � whatever
  624. the plants were, whatever the industry was, they would
  625. have to, retrofit their operations. That will cost money.
  626. They will pass that money on to consumers.�
  627.  
  628.  �So if somebody wants to build a coal-powered plant,
  629. they can; it�s just that it will bankrupt them,� Obama
  630. said, �because they�re going to be charged a huge sum for
  631. all that greenhouse gas that�s being emitted.�
  632.  
  633.  Obama�s prediction about coal plants have been proven
  634. true. As Off The Grid News previously reported, in October
  635. 2013, FirstEnergy Corp announced that it would shut down
  636. two coal-fired powered plants in Pennsylvania because it
  637. said the cost of complying with EPA regulations was too high.
  638.  
  639.  Reuters estimated that coal-burning power plants capable
  640. of generating 15,000 megawatts of electricity have shut
  641. down since Obama took office in 2009. The news service
  642. also estimates that power plants that generate around
  643. 37,000 megawatts of power will close in the next 10
  644. years. One megawatt can provide electricity to up to
  645. about 1,000 homes.

  647. Awfully Expensive Electricity
  648.  
  649.  Those plants will be closing at a time when demand for
  650. electricity is increasing. That will force utilities to
  651. build power plants that burn other fuels such as natural
  652. gas. It will add additional cost to electricity rates at
  653. a time when the rates are already going up dramatically.
  654.  
  655.  �It could get awfully expensive,� Daniel Simmons of the
  656. Institute for Energy Research told World Net Daily. �Some
  657. people might see their electricity rates double. If there�s
  658. no backup power plants, that means electricity is going to
  659. get awfully expensive when you have shortages around the
  660. country.
  661.  
  662. Another Obama Plan To Raise Your Electric Bill

  664.  �We�re talking about dramatically increasing the cost of
  665. electricity all to reduce carbon dioxide emissions. I
  666. think that is the real goal,� Simmons said.

  668.  Another Obama administration plan to reduce greenhouse
  669. emissions, Carbon Capture and Sequestration, or CSS technology,
  670. could raise electricity costs even more, Simmons predicted.
  671. He noted that a an experimental CSS power plant in the
  672. United States will cost an estimated $4.3 billion to build
  673. and the EPA doesn�t know if the technology would work.

  675.  �The technology is awfully expensive because it hasn�t
  676. been tried anywhere, and that�s to try to capture the
  677. carbon dioxide as it comes out after they burn the coal.�
  678. Simmons said of CSS.

  680.  CSS involves the use of filters to divert carbon emissions
  681. from the air � and every taxpaying American will pay. The
  682. CSS plants under construction will require $300 million in
  683. taxpayer subsidies.

  686. of the Obama administration�s policy on coal.

  814. proven technology as there are no commercial-scale
  815. coal plants in the country that uses the technology.
  816. In fact, when the Environmental Protection Agency
  817. wrote its rule limiting coal plant emissions it only
  818. cited CCS projects that were government funded and
  819. not in operation.

  821.  �It is disingenuous to state that the technology is
  822. �ready,�� said Charles McConnell, former assistant
  823. secretary of energy in Obama. �Studies have verified
  824. that implementation of [CSS] technology is necessary
  825. to comply with EPA�s proposed [EPA carbon-emissions
  826. limits] regulation and meet the [greenhouse gas]
  827. targets necessary for limiting CO2 emissions to our

  1031. even more troubling is the connection between �smart�
  1032. meters and military R&D funding.

  1468.  I remember very distinctly the attitude on the
  1469. Georgia Tech campus toward the environmental �science�
  1470. department. I�m sure that much of what was studied by
  1471. environmental science majors was legitimate, especially
  1472. as it concerned local phenomena and processes. But
  1473. when it comes to the global aspects of environmental
  1474. science (weather systems, causation, the long-term
  1475. effects of pollution, etc.), it becomes obvious that
  1476. environmental scientists are less reliable than
  1477. weathermen and relying heavily on extremely speculative
  1478. models of explanation.
  1479.  
  1480.  Pollution is defined by concentrations. Nothing that
  1481. is considered a pollutant is necessarily bad intrinsically
  1482. or necessarily. Even toxic elements occur naturally at
  1483. low concentrations. The EPA determines what those
  1484. concentrations are allowed to be in order to still
  1485. be considered �safe.� And recently, the EPA has been
  1486. narrowing those regulations even further, most recently
  1487. in an attempt to force businesses to �go green.� But
  1488. as it turns out, for years, the EPA has created and
  1489. enforced regulations based on data that it pawned off
  1490. as �hard science� that is impossible to reproduce
  1491. independently. It was secret science. Pet science.

  1610. not want to part with their piece of Colorado heaven.

  1619. on their energy bill because a green tax cut has been

  1624. � will save money this year after the Government slashed

  1919. in the White House�s secret EPA squelch squad. �It�s
  1920. disturbing that even investigations by this administration�s
  1921. own nonpartisan watchdogs are being blocked by political

  1932. Obama administration) an unfavorable ruling in the case of
  1933. Sackett v. US, but it�s the events leading up to that high
  1934. court hearing that boil the blood of constitutionalists

  1936. editor of The New American:

  1939. the federal government were fining you $75,000 per day? A
  1940. couple of hours, maybe � or a few minutes? Not many
  1941. homeowners could handle that kind of crushing financial
  1942. blow. Even a Bill Gates, a Warren Buffett, or a George
  1943. Soros might blanch at such astronomical fines.
  1944.  
  1945.  But that was the potential cost facing Idaho couple Mike
  1946. and Chantelle Sackett ... who ran into the iron fist of
  1947. the Environmental Protection Agency (EPA) when they began
  1948. building their home in 2007 on a two-thirds acre parcel in
  1949. a residential neighborhood of Priest Lake. Like their
  1950. neighbors who had already built homes next door, the
  1951. Sacketts got their permits from the county and began
  1952. laying gravel and preparing the ground for building.
  1953. That�s when the EPA came in and, without hearings or
  1954. notice, declared that the property is �wetlands� and
  1955. ordered the Sacketts to restore it to the EPA bureaucracy�s
  1956. satisfaction.
  1957.  
  1958.  The Sacketts, having good reasons to believe their
  1959. property is not a wetlands, were determined to contest
  1960. the EPA order. However, the EPA denied their request for
  1961. a hearing. They sought judicial relief, but the US Ninth
  1962. Circuit Court of Appeals sided with the EPA, ruling that
  1963. the Sacketts had no right to immediate judicial review
  1964. of the matter. The Ninth Circuit held that the couple
  1965. would first have to go through the EPA�s years-long
  1966. wetlands permit process, which would end up costing the
  1967. property owners many times the value of their land!
  1968.  
  1969.  Basically, a group of unelected and unaccountable federal
  1970. officials has shattered the dreams of the Sackett family,
  1971. robbed them of the due process of law guaranteed to every
  1972. citizen by the Constitution, and charged them $75,000 a
  1973. day for the privilege.
  1974.  
  1975.  The Sacketts understood the enormity of the issue raised
  1976. by their pouring of a little gravel on less than an acre
  1977. of land. Said Mrs. Sackett in the days leading up to the
  1978. Supreme Court decision, �The EPA can come in and turn your
  1979. life upside down. They can make you feel really small and
  1980. insignificant. And they take away from you your sense of
  1981. America.�
  1982.  
  1983.  The EPA is not content to obliterate property rights,
  1984. however. Recent actions taken against the country's last
  1985. lead smelting facility will affect the right to keep and
  1986. bear arms, as well, by substantially impacting the production
  1987. of ammunition. On December 31, 2013, the lead refining plant
  1988. closed for good.
  1989.  
  1990.  The St. Louis Post-Dispatch reported just before the
  1991. shuttering of the plant:

  1993.  About 145 employees of the Doe Run lead smelter [in Herculaneum,
  1994. Missouri] learned they will lose their jobs at the end of
  1995. December because of the plant�s closure, the Doe Run Co.
  1996. said Wednesday. An additional 73 contractor jobs also will
  1997. be eliminated.
  1998.  
  1999.  By forcibly closing this plant, the Obama administration
  2000. took yet another unconstitutional step � one that will
  2001. severely impinge on the nation�s ammunition-manufacturing
  2002. capability.
  2003.  
  2004.  Why would the Doe Run Company, the owners of the Missouri
  2005. lead smelting facility, agree to being run out of business
  2006. by the EPA? One word: extortion.
  2007.  
  2008.  In a document published on its website, the EPA explains
  2009. that in order for Doe Run to continue its operations, the
  2010. company would have to agree to pay �$65 million to correct
  2011. violations of several environmental laws at 10 of its lead
  2012. mining, milling and smelting facilities in southeast Missouri.
  2013. The settlement also requires the company to pay a $7 million
  2014. civil penalty.�
  2015.  
  2016.  In a statement to the press, Doe Run said the fine and the
  2017. required upgrades to its facilities were �too financially
  2018. risky.�
  2019.  
  2020.  In cases such as those of the Sacketts, the Doe Run smelting
  2021. facility, and scores of others nationwide, the EPA�s heavy
  2022. handed, unconstitutional tactics should have been investigated
  2023. and the nearly unbounded power should have been reined in.

  2025.  They carried on without oversight, however, and perhaps
  2026. now we know why.

  2028.  Many who have felt the wrath of the dictators�s shadowy
  2029. EPA division are hopeful that the House�s committee hearings

  2039. on Monday as surfers battle venture capitalist Vindo Khosl
  2040. over access to a popular northern California beach. The
  2041. case may be the most significant challenge to the state�s

  2045. Foundation has accused Khosla �of flouting the California
  2046. Coastal Act when he blocked the only road into Martins

  2050. �Surfrider, in this lawsuit, is asking to protect an
  2051. access right that simply doesn�t exist.� But they were
  2052. denied their motion to prevent Khosla from testifying in
  2053. the matter, and Khosla will have to do so on Monday as
  2054. the trial resumes.

  2056.  As the Chronicle noted, a 1972 �California Coastal Zone
  2057. Conservation Initiative� made the �entire coast public
  2058. property, including beaches below the mean high tide,�
  2059. and the lawsuit presents the biggest challenge to that
  2060. initiative.

  2062.  Khosla �is famous for his backing of bold, eco-friendly
  2063. projects and is a darling of Democratic politicians,� and
  2064. is company paid �$37.5 million for the property, which
  2065. includes 45 leased cabins along the coastal cliffs.�

  2067.  Surfrider is claiming that since the �closed gate means
  2068. the only way people can get there is from the ocean,�
  2069. Khosla is in violation of the �public access provisions
  2070. in the coastal act.�

  2073. previous historic $5 �beach fees prove that the public never
  2074. had a right to access that beach.�

  2210. counties to control where and how things are bought and

  2213. details of zoning are excruciatingly complex leaving people
  2214. unable to respond in a timely manner. The enforcement of
  2215. zoning regulations involves heavy fines and/or incarceration.
  2216. In short, zoning has been a terrific way for counties to
  2217. control people�s lives.

  2219.  Such is the story of oyster farmer Anthony Bavuso and his
  2220. family. After years of working corporate and office jobs,
  2221. Bavuso and his wife took a short hiatus from the day-to-day
  2222. drudgery and returned with a new perspective: they wanted to
  2223. become contributors to the economy of raw materials by producing
  2224. something that people needed.
  2225.  
  2226.  Bavuso moved his family back to their home state of Virginia
  2227. with the dream of becoming food producers. Having access to a
  2228. waterfront property, and a background in oyster gardening, it
  2229. made sense to start an oyster farm. Like other types of farming,
  2230. oyster farmers have to manage the growth of their oysters � a
  2231. labor-intensive process requiring a high level of experience.
  2232. An added benefit, for Bavuso, was the knowledge that oysters
  2233. clean the water. As a lifelong Virginian, the health of the
  2234. Chesapeake Bay is never far from his mind. (Oysters eat algae,
  2235. which proliferates in the pollution of the bay, and turn the
  2236. algae into usable protein for humans.)  So the Bavuso family
  2237. started Seaford Oyster Company in Seaford, Virginia.
  2238.  
  2239.  York County maintains a set of zoning ordinances regulating
  2240. various aspects of farming.  There are a list of things that
  2241. are allowed, and if an activity is not on the list, the county
  2242. prohibits it. Penalties include steep fines and possible
  2243. incarceration. Small changes to the zoning ordinances can
  2244. easily disrupt industries and people�s livelihoods.
  2245.  
  2246.  In 2010, Bavuso followed regulatory procedure within his zoning
  2247. district for an oyster farm. He established a lease with the
  2248. Commonwealth of Virginia that gave him the �rights� to the
  2249. section of the bottomland in the Poquoson River adjacent to
  2250. his property. (The bottom lease gives farmers access to
  2251. shellfish only.) Additional regulations and permits involved
  2252. food safety. Wanting to show his interest in producing the
  2253. safest food possible, Bavuso complied with the entire permitting
  2254. process.
  2255.  
  2256.  Prior to starting the farm, the family looked at this list of
  2257. zones and restrictions. In the Bavuso�s zone, farming is �permitted
  2258. by right.� This means for people to farm the land, they need no
  2259. additional land use permits from the county. According to the
  2260. definition of aquaculture in the code, what Bavuso is doing is
  2261. considered part of what is �permitted by right.�
  2262.  
  2263.  By 2011, after more than a year of farming, refining his expertise
  2264. and growing his customer base, Bavuso read in a local newspaper
  2265. that the county was planning on rezoning to remove agriculture
  2266. activities from Bavuso�s �zone.� A �zone� is any area that the
  2267. county designates. Within each zone, the county stipulates what
  2268. particular activities can take place. Once designated, the county
  2269. applies regulations and restrictions. For example, one common
  2270. zoning requirement is that if an area is zoned for residential
  2271. building, there are restrictions and regulations determining
  2272. how from the property line a structure can be built.

  2274.  Bavuso wanted to make sure that he would be grandfathered in and
  2275. that these changes would not affect his farming operation. He
  2276. didn�t know it at the time, but the ordinance was crafted to
  2277. punish a fellow oyster farmer by the name of Greg Garrett. The
  2278. rezoning effort was a actually a political vendetta to punish
  2279. Garrett for supporting a challenger to a currently elected
  2280. member of the York County Board of Supervisors (BOS). Bavuso
  2281. has gotten caught up in that because he does not agree with
  2282. the agenda of the BOS either. And so began what would be at
  2283. least 3 years of limbo for a peaceful man and his family. After
  2284. his vocal opposition, Mr. Bavuso is now is convinced that they
  2285. are attacking him, personally.

  2366.  
  2367.  The proposed standard is 1,100 pounds of CO2 per megawatt
  2368. hour of electricity produced. Today�s most advanced commercial
  2369. coal power plants emit 1,800 pounds of CO2 per megawatt hour.
  2370. New plants could comply only by installing carbon capture and
  2371. storage (CCS) technology � a capability that can add 80% to
  2372. the cost of building a new coal plant.
  2373.  
  2374.  To make the proposal look reasonable, EPA has to bend reality
  2375. a lot. Under section 111(b) of the Clean Air Act, NSPS are to
  2376. reflect the �best system of emission reduction� that has been
  2377. �adequately demonstrated.� EPA claims CCS is adequately
  2378. demonstrated -- but there are no commercial-scale power
  2379. plants operating anywhere with CCS, and none is being built
  2380. without heavy taxpayer and/or consumer subsidies.

  2382.  In short, a utility that builds a new coal plant with CCS,
  2383. as required by EPA�s ruling, risks going bankrupt. The rule
  2384. is thus an informal ban on investment in new coal power

  2429. could be a major threat to America�s bee population, farms
  2430. and the nation�s food supply. That�s the charge being made
  2431. by the Center for Food Safety and beekeepers.

  2433.  The agency is proposing more uses for thiamethoxam,
  2434. apesticide that has been banned in the European Union
  2435. because it is considered a threat to bees. A letter from
  2436. the Center to the Environmental Protection Agency raises
  2437. some serious concerns about thiamethoxam and another
  2438. pesticide, sulfoxaflor.

  2440.  �Peer-reviewed scientific studies have consistently shown
  2441. that these systemic chemicals are highly toxic to honeybees,
  2442. other pollinators and beneficial insects,� the letter
  2443. states. �Pollinator losses represent a serious threat to

  2445. these systemic pesticides have also been shown to negatively

  2455. bees that died from colony collapse tested positive for
  2456. neonicotinoids. AHarvard study this year also tied bee

  2491. the pond, which they claim is actually a �dam.�

  2505. followed state regulations in building it. He has an approval
  2506. etter from the Wyoming State Engineer�s Office as proof, which
  2507. states:

  2509.  �Said permit is in good standing and is entitled to be exercised
  2510. exactly as permitted,� says the letter.
  2511.  
  2512.  The agency is threatening to hit the family with up to $75,000 a
  2513. DAY in fines. Johnson said he�s not paying them a cent:

  2515.  �I have not paid them a dime nor will I. I will go bankrupt if I
  2516. have to fighting it. My wife and I built [the pond] together. We
  2517. put our blood, sweat and tears into it. It was our dream.�
  2518.  
  2519.  Of course, the EPA isn�t backing down. They argue that Johnson
  2520. needs to either restore the land or pay the fines. On January 30,
  2521. the agency gave Johnson 30 days to hire a consultant to assess the
  2522. impact of the supposed unauthorized work and to create a restoration
  2523. proposal. That proposal has to be approved by the EPA, of course,
  2524. and it must contain a schedule. All work would have to be completed
  2525. within 60 days of the plan�s approval.

  2527.  Sounds like they are setting him for failure, doesn�t it? Even if
  2528. he DID violate the law and agreed to make things right, would meeting
  2529. those terms even be possible?

  2531.  If Johnson does not comply with those terms, the EPA is going to
  2532. fine him $37,500 per day in civil penalties, along with $37,500 more
  2533. every day for statutory violations.

  2535.  Johnson is fighting back and has gained the support of three Republican
  2536. senators � John Barrasso and Mike Enzi, who both represent Wyoming �
  2537. and Louisiana Sen. David Vitter, Fox News reports:

  2539.  The Republican lawmakers sent a March 12 letter to Nancy Stoner, the
  2540. EPA�s acting assistant administration for water, saying they were
  2541. �troubled� by Johnson�s case and demanding the EPA withdraw the
  2542. compliance order.

  2544.  �Rather than a sober administration of the Clean Water Act, the
  2545. Compliance Order reads like a draconian edict of a heavy-handed
  2546. bureaucracy,� the letter states.
  2547.  
  2548.  The letter also questions the EPA�s claim that Johnson�s pond is
  2549. actually a dam:
  2550.  
  2551.  �Fairness and due process require the EPA base its compliance order
  2552. on more than an assumption,� they wrote. �Instead of treating Mr.
  2553. Johnson as guilty until he proves his innocence by demonstrating his
  2554. entitlement to the Clean Water Act section 404 (f)(1)(C) stock pond
  2555. exemption, EPA should make its case that a dam was built and that the
  2556. Section 404 exemption does not apply.

  2558.  �If the compliance order stands as an example of how EPA intends
  2559. to operate after completing its current �waters of the United States�
  2560. rule-making, it should give pause to each and every landowner throughout
  2561. the country.�

  2563.  Johnson said his battle with the EPA is serving as a learning
  2564. experience for his children:

  2566.  �This is showing them that they shouldn�t back down. If you need to
  2567. stand up and fight, you do it.

  2570. have three little kids. I am not going to roll over and let [the government]
  2571. tell me what I can do on my land. I followed the rules.�

  2574. protecting the environment is bad enough, but some say that the
  2575. astronomical fines are perhaps an even bigger issue � and may even
  2576. be unconstitutional, as Evan Bernick of The Foundry explains:

  2578.  But the eye-popping aspect of this story is the severity of the
  2579. penalties threatened. It�s absurd to threaten someone with tens of
  2580. thousands of dollars in fines because he or she lacks a permit. And
  2581. it might also be unconstitutional.
  2582.  
  2583.  The Framers of our Constitution recognized that, at a certain point,
  2584. penalties become unconstitutionally disproportionate. The Eighth
  2585. Amendment�s Excessive Fines Clause reflects that understanding. In
  2586. Austin v. U.S. (1993), and again in U.S. v. Bajakajian (1998), the
  2587. U.S. Supreme Court explained that �[t]he Excessive Fines Clause
  2588. limits the government�s power to extract payments, whether in cash
  2589. or in kind, as punishment for some offense,� and held that civil
  2590. sanctions that do not serve solely remedial purposes are subject
  2591. to the Excessive Fines Clause. It is impossible to understand the
  2592. threatened fines as serving a purely remedial purpose�surely,
  2593. repairing any damage that Johnson inflicted would cost less than
  2594. $75,000 a day. But, under the terms of the CWA, he is potentially
  2595. subject to such penalties as a consequence of his failure to obtain
  2596. a permit.

  2598.  This is just another sad case of big government stomping all over
  2599. the little guy. Hopefully the EPA won�t get away with destroying the
  2600. Johnsons� hard work and are stopped from sending the family into
  2601. financial ruin.

  2606.  Since President Barack Obama took office on Jan. 20, 2009, the
  2607. Environmental Protection Agency (EPA) has issued 2,827 new final
  2608. regulations, equaling 24,915 pages in the Federal Register,
  2609. totaling approximately 24,915,000 words.

  2618.  Well, this puts a new spin on the term �government waste�:
  2619. confounded with the problem of an unknown individual leaving
  2620. feces in public hallways, a regional branch of the Environmental
  2621. Protection Agency hired an outside consultant to inform their
  2622. employees that pooping in hallways is bad.
  2623.  
  2624.  Government Executive got their hands on an email from the
  2625. management EPA�s Region 8 in Denver, Colo., in which a supervisor
  2626. begged his employees to stop �placing feces in the hallway� and
  2627. clogging up toilets with paper towels. While this is, obviously,
  2628. a very disgusting matter, the story veers into pretty dumb
  2629. territory soon:

  2631.  Confounded by what to make of this occurrence, EPA management
  2632. �consulted� with workplace violence �national expert� John
  2633. Nicoletti, who said that hallway feces is in fact a health and
  2634. safety risk. He added the behavior was �very dangerous� and the
  2635. individuals responsible would �probably escalate� their actions.
  2636.  
  2637.  According to his bio, Nicoletti is, indeed, a nationally-recognized
  2638. expert on workplace and school violence prevention, with accolades
  2639. from the National Science Foundation and numerous chairmanships.
  2640. He�s even �a member of NASA�s team for developing analog�s for
  2641. training astronauts for long duration missions, such as the
  2642. Mars Mission.�
  2643.  
  2644.  Why such a distinguished mind was consulted by the EPA to reach
  2645. the conclusion that �placing feces in the hallway� is bad, we�ll
  2646. never know.
  2647.  
  2648.  NOTE: these are the kinds of people who are calling for total
  2649. micro-managment over all aspects of the American economy ...

  2654. (84) Vets Died as VA Obsessed Over Renewable �Green� Energy

  2656. The sick and halt wait but the solar panels don�t.
  2657.  
  2658.  The administrators at the Veterans Administration have
  2659. apparently been busy while old soldiers waited to see a
  2660. doctor, after all. Serving those who served is not necessarily
  2661. a priority, but saving the planet is Job 1. Solar panels and
  2662. windmills can be more important than the touch of a healing
  2663. hand.
  2664.  
  2665.  The department early on set up an Office of Green Management
  2666. Programs designed to �help VA facilities nationwide recognize
  2667. opportunities to green VA, and to reward innovative �green�
  2668. practices and efforts by individual facilities and staff within
  2669. the VA.� This sometimes means paying more attention to greening
  2670. the department and saving the polar ice caps than to health care.
  2671.  
  2672.  In the department�s words, it adopted a far more important
  2673. mission to �become more energy efficient and sustainable, focusing
  2674. primarily on renewable energy, energy and water efficiency,
  2675. [carbon-dioxide] emissions reduction, and sustainable buildings.�
  2676.  
  2677.  The green office isn�t merely a desk and telephone tucked away
  2678. in the dark corner of a nondescript government building. It�s a
  2679. substantial undertaking, with all the luxury, bells and whistles
  2680. of a bureaucracy that means business. Eric K. Shinseki, who
  2681. resigned as secretary in the wake of the VA scandal of the sin
  2682. of omission, traveled the country to boast of the green initiative.
  2683. In one instance, he traveled to Massachusetts to flick the switch
  2684. at a half-million-dollar windmill project at the Massachusetts
  2685. National Cemetery. �Nationally,� he said, �VA continues to expand
  2686. its investment in renewable sources of energy to promote our
  2687. nation�s energy independence, save taxpayer dollars, and improve
  2688. care for our veterans and their families.
  2689.  
  2690.  VA facilities have become littered with every scheme to banish
  2691. carbon dioxide short of requiring visitors to hold their breath.
  2692. Calverton National Cemetery spent $742,034 on solar panels. Fort
  2693. Rosecrans National Cemetery spent $787,308. Not to be out-greened,
  2694. the Riverside National Cemetery spent $1.3 million on its solar
  2695. system.
  2696.  
  2697.  At the Phoenix VA Health Care System, where 20 Americans died from
  2698. incompetence and cover-up, the department spent $20 million putting
  2699. solar panels on the hospital roofs. That would have been more than
  2700. enough money to provide the veterans with the health care they deserved.
  2701.  
  2702.  Some administrators won�t be satisfied until every federal building
  2703. bears a green stamp. In military parlance, the VA is practicing
  2704. �mission creep,� the expansion of a project well beyond its intended
  2705. goals. While the rest of the government continues to waste taxpayer
  2706. funds trying to become carbon-dioxide neutral, the VA should be
  2707. spending every available dollar to relieve pain, cure the sick and
  2708. restore the deserving to health. That�s more important than any fad,
  2709. environmental or otherwise.
