  272. provide warmth for injured and recovering birds,
  273. after the federal government banned manufacturers
  274. from making the bulbs.

  276.  In Canada, the more energy-efficient compact
  277. fluorescent light bulbs are considered the norm.
  278. The incandescent light bulbs use more power, but
  279. they are also warmer and serve an important role
  280. inside incubators.

  282.  �As the light bulb is on, it will obviously warm
  283. things up and then the setting will turn it off to
  284. keep the right temperature,� explained Mireille
  285. Goguen, who works at the centre.
  286.  
  287.  She said they were caught off-guard by the bulb
  288. ban and they are already running short on
  289. incandescent bulbs. Now they are asking people
  290. to donate 100-watt bulbs.
  291.  
  292.  �(We will take) as many as possible. If people
  293. have them hanging around we will take them or if
  294. they want to buy them for us it would be much
  295. appreciated,� said Goguen.

  298. which is located on Moodie Drive in the city�s

  307. Wednesday to call on the San Diego City Council to
  308. abandon the plan to remove plastic bags from local
  309. stores.

  312. of the Neighborhood Market Association, held a press
  313. conference in front of Rainbow Market on Federal
  314. Boulevard in which they called the proposed ban a
  315. tax scam that will negatively impact working-class
  316. San Diegans.

  318.  �This is a terrible plan. It�s terrible because
  319. the solution is worse than the so-called problem,�
  320. said Arabo. �It�s a classic case of politicians
  321. attempting to do something for the environment,
  322. in part to appease some environmental groups,
  323. without seeing the bigger picture.�

  325.  The proposed ban would remove plastic bags from
  326. stores while imposing a paper bag tax on customers.
  327. Shoppers would be charged 10 cents for each paper
  328. bag they might need at a store.
  329.  
  330.  �This ban will have reaching ramifications. It�ll
  331. cost taxpayers � mothers, fathers and brothers �
  332. more money when they go shopping for groceries,�
  333. said Arabo.

  335.  Though the ban is designed to reduce waste and
  336. help the environment, Arabo argued that plastic
  337. bags only make up one-third of one percent of
  338. the waste stream.

  340.  On the other end of the plastic bag ban debate,
  341. Sherri Lightner, San Diego City Council President
  342. Pro Tem, District 1, supports the proposed ban.

  349.  The state mandates water-saving toilets and showers
  350. in all homes, but obviously didn�t think long about
  351. how to achieve that.

  353.  First the city of Chico had the ban on nuclear weapons,
  354. then wood-burning stoves, then plastic bags. Now
  355. comes a ban on high-flow toilets. And if you think
  356. the city can�t enforce that, then you haven�t met
  357. the toilet police.
  358.  
  359.  OK, so the title �Toilet Police� probably doesn�t
  360. appear on any city worker�s business card, but
  361. that�s what they are.
  362.  
  363.  But let�s not blame city building inspectors for
  364. an odd law � or even the Chico City Council. For
  365. once, this ridiculous save-the-world concept doesn�t
  366. come from the council, but rather from the busybodies
  367. in the state Legislature. They passed a law that took
  368. effect Jan. 1 that requires water-conserving plumbing
  369. fixtures on any home built before 1994.
  370.  
  371.  How will that be enforced? Well, if a property has
  372. any work done that requires a building permit from
  373. a city or county, that entity�s inspector must verify
  374. that the home has low-flow toilets, showers and faucets.
  375.  
  376.  To make it even more disturbing, the low-flow
  377. inspection doesn�t occur if you�re getting plumbing
  378. work. It occurs if you�re getting any work that requires
  379. a building permit, such as getting a new heater, new
  380. windows or converting a garage into a den. Uh, maybe.
  381.  
  382.  So under the letter of the law, if a homeowner buys
  383. a new water heater or fireplace insert for a couple
  384. hundred dollars, he or she might spend considerably
  385. more than that converting all toilets, faucets and
  386. showerheads to low-flow devices.
  387.  
  388.  City and county building inspectors don�t want to be
  389. toilet police. We can�t imagine them wanting to spend
  390. time checking a person�s toilet when they�re there
  391. to check an air conditioner. They�re taking a loose
  392. interpretation of the law for now, and won�t inspect
  393. toilets during projects like repairs and maintenance
  394. that don�t involve plumbing.
  395.  
  396.  But there�s no guarantee the state, which passed
  397. the law, won�t require cities and counties to enforce
  398. a strict interpretation.
  399.  
  400.  With all the uncertainty, it entices a homeowner to
  401. ignore the government requirement to get a building
  402. permit for minor home improvement projects.
  403.  
  404.  Governments should be concerned if fewer people take
  405. out building permits. It means less revenue for
  406. cash-strapped local governments.
  407.  
  408.  The building industry is concerned that residents
  409. may put off rebuilding and home improvement projects
  410. because they would include this unwanted expense.
  411. With the building industry and contractors finally
  412. showing signs of recovery from the recession, we
  413. don�t want to see new obstacles.
  414.  
  415.  Once again the state passes a goofy law without
  416. thinking about the consequences, since somebody else
  417. has to enforce it. The city and county building
  418. departments urge residents not to be scared off by
  419. the new laws, to call and ask questions. It seems
  420. they are like the rest of us, trying to figure out
  421. how long they can ignore the fools in Sacramento
  422. before they get caught.

  433. for �improving their homes� efficiency.�

  436. to reduce the nation�s energy consumption; but it�s
  437. also billed as a way to keep home-retrofitting going,
  438. at a time when stimulus funds for weather-proofing
  439. have run out - you see, the federated fascists care
  440. more about spying on our energy consumption rather
  441. than providing weather-proof options for our homes.

  458. domain and can confiscate private property to build
  459. �sustainable communities.� The bill essentially paves
  460. the way for the loss of any true private property in
  461. California, resulting in the loss of freedom and
  462. driving down home values. If the Senate passes the
  463. modified bill, only Governor Jerry Brown (D � CA)
  464. will stand in its way of becoming law.

  466.  This means that city and county governments can
  467. create unelected bureaucracies with the power to do
  468. what�s necessary to create �sustainable communities.�
  469. It also means that the definition of �blight� will
  470. change from the original definition of abandoned
  471. and decaying buildings on residential lots to a
  472. much wider definition including anything the
  473. bureaucracies need to create sustainable communities.

  475.  Not only would the government be able to use eminent
  476. domain to procure land for public transportation,
  477. it could take private homes within half a mile of
  478. that public transportation in the name of creating
  479. a sustainable community. A private home is not
  480. really private if it could be taken at any time
  481. to create low income, low energy housing.

  483.  According to Lawrence J. McQuillan, �each Authority
  484. will be granted powers to build �Sustainable Communities�
  485. means jamming people into dense, urban centers using
  486. high-density residential housing and high-intensity
  487. retail and commercial buildings near mass transit

  528. has announced, for the first time ever, new regulations
  529. for medium- and heavy-duty trucks regarding both fuel
  530. economy requirements and emissions standards.

  532.  The new standards are the result of a mandate first
  533. set in motion in 2007 by Congress, and later by an
  534. Executive Order issued by President Obama in May of
  535. last year. The regulations will apply to medium and
  536. heavy-duty trucks built in 2014 through 2018, aimed
  537. at reducing annual national fuel consumption by 530
  538. million barrels.

  540.  The new regulations will be aimed at one of three
  541. specific subsets of trucks: combination tractors
  542. (commonly referred to as semi-trucks), heavy-duty
  543. pickup trucks and vans and vocational vehicles.

  545.  Each category will have its own regulations, but
  546. the end goal is to reduce fuel consumption by as
  547. much as 20 percent by 2018, which is the case for

  588. Obama Admitted Plan Would Raise Electricity Rates

  590.  There is some evidence that President Obama has a
  591. deliberate strategy of increasing electricity rates and
  592. destroying the coal industry.

  594.  �Under my plan of a cap-and-trade system, electricity
  595. rates would necessarily skyrocket,� Obama told the editorial
  596. board of The San Francisco Chronicle in 2008. �Even
  597. regardless of what I say about whether coal is good or
  598. bad. Because I�m capping greenhouse gases, coal power
  599. plants, you know, natural gas, you name it � whatever
  600. the plants were, whatever the industry was, they would
  601. have to, retrofit their operations. That will cost money.
  602. They will pass that money on to consumers.�
  603.  
  604.  �So if somebody wants to build a coal-powered plant,
  605. they can; it�s just that it will bankrupt them,� Obama
  606. said, �because they�re going to be charged a huge sum for
  607. all that greenhouse gas that�s being emitted.�
  608.  
  609.  Obama�s prediction about coal plants have been proven
  610. true. As Off The Grid News previously reported, in October
  611. 2013, FirstEnergy Corp announced that it would shut down
  612. two coal-fired powered plants in Pennsylvania because it
  613. said the cost of complying with EPA regulations was too high.
  614.  
  615.  Reuters estimated that coal-burning power plants capable
  616. of generating 15,000 megawatts of electricity have shut
  617. down since Obama took office in 2009. The news service
  618. also estimates that power plants that generate around
  619. 37,000 megawatts of power will close in the next 10
  620. years. One megawatt can provide electricity to up to
  621. about 1,000 homes.

  623. Awfully Expensive Electricity
  624.  
  625.  Those plants will be closing at a time when demand for
  626. electricity is increasing. That will force utilities to
  627. build power plants that burn other fuels such as natural
  628. gas. It will add additional cost to electricity rates at
  629. a time when the rates are already going up dramatically.
  630.  
  631.  �It could get awfully expensive,� Daniel Simmons of the
  632. Institute for Energy Research told World Net Daily. �Some
  633. people might see their electricity rates double. If there�s
  634. no backup power plants, that means electricity is going to
  635. get awfully expensive when you have shortages around the
  636. country.
  637.  
  638. Another Obama Plan To Raise Your Electric Bill

  640.  �We�re talking about dramatically increasing the cost of
  641. electricity all to reduce carbon dioxide emissions. I
  642. think that is the real goal,� Simmons said.

  644.  Another Obama administration plan to reduce greenhouse
  645. emissions, Carbon Capture and Sequestration, or CSS technology,
  646. could raise electricity costs even more, Simmons predicted.
  647. He noted that a an experimental CSS power plant in the
  648. United States will cost an estimated $4.3 billion to build
  649. and the EPA doesn�t know if the technology would work.

  651.  �The technology is awfully expensive because it hasn�t
  652. been tried anywhere, and that�s to try to capture the
  653. carbon dioxide as it comes out after they burn the coal.�
  654. Simmons said of CSS.

  656.  CSS involves the use of filters to divert carbon emissions
  657. from the air � and every taxpaying American will pay. The
  658. CSS plants under construction will require $300 million in
  659. taxpayer subsidies.

  790. proven technology as there are no commercial-scale
  791. coal plants in the country that uses the technology.
  792. In fact, when the Environmental Protection Agency
  793. wrote its rule limiting coal plant emissions it only
  794. cited CCS projects that were government funded and
  795. not in operation.

  797.  �It is disingenuous to state that the technology is
  798. �ready,�� said Charles McConnell, former assistant
  799. secretary of energy in Obama. �Studies have verified
  800. that implementation of [CSS] technology is necessary
  801. to comply with EPA�s proposed [EPA carbon-emissions
  802. limits] regulation and meet the [greenhouse gas]
  803. targets necessary for limiting CO2 emissions to our

  1419. the �science� it has been using for years as the
  1420. justification for its Clean Air Act.

  1422.  I remember very distinctly the attitude on the
  1423. Georgia Tech campus toward the environmental �science�
  1424. department. I�m sure that much of what was studied by
  1425. environmental science majors was legitimate, especially
  1426. as it concerned local phenomena and processes. But
  1427. when it comes to the global aspects of environmental
  1428. science (weather systems, causation, the long-term
  1429. effects of pollution, etc.), it becomes obvious that
  1430. environmental scientists are less reliable than
  1431. weathermen and relying heavily on extremely speculative
  1432. models of explanation.
  1433.  
  1434.  Pollution is defined by concentrations. Nothing that
  1435. is considered a pollutant is necessarily bad intrinsically
  1436. or necessarily. Even toxic elements occur naturally at
  1437. low concentrations. The EPA determines what those
  1438. concentrations are allowed to be in order to still
  1439. be considered �safe.� And recently, the EPA has been
  1440. narrowing those regulations even further, most recently
  1441. in an attempt to force businesses to �go green.� But
  1442. as it turns out, for years, the EPA has created and
  1443. enforced regulations based on data that it pawned off
  1444. as �hard science� that is impossible to reproduce
  1445. independently. It was secret science. Pet science.
  1446. Not hard science:

  1867. the federal government were fining you $75,000 per day? A

  1871. Soros might blanch at such astronomical fines.

  1873.  But that was the potential cost facing Idaho couple Mike
  1874. and Chantelle Sackett ... who ran into the iron fist of
  1875. the Environmental Protection Agency (EPA) when they began
  1876. building their home in 2007 on a two-thirds acre parcel in
  1877. a residential neighborhood of Priest Lake. Like their
  1878. neighbors who had already built homes next door, the
  1879. Sacketts got their permits from the county and began
  1880. laying gravel and preparing the ground for building.
  1881. That�s when the EPA came in and, without hearings or
  1882. notice, declared that the property is �wetlands� and
  1883. ordered the Sacketts to restore it to the EPA bureaucracy�s
  1884. satisfaction.
  1885.  
  1886.  The Sacketts, having good reasons to believe their
  1887. property is not a wetlands, were determined to contest
  1888. the EPA order. However, the EPA denied their request for
  1889. a hearing. They sought judicial relief, but the US Ninth
  1890. Circuit Court of Appeals sided with the EPA, ruling that
  1891. the Sacketts had no right to immediate judicial review
  1892. of the matter. The Ninth Circuit held that the couple
  1893. would first have to go through the EPA�s years-long
  1894. wetlands permit process, which would end up costing the
  1895. property owners many times the value of their land!
  1896.  
  1897.  Basically, a group of unelected and unaccountable federal
  1898. officials has shattered the dreams of the Sackett family,
  1899. robbed them of the due process of law guaranteed to every
  1900. citizen by the Constitution, and charged them $75,000 a
  1901. day for the privilege.
  1902.  
  1903.  The Sacketts understood the enormity of the issue raised
  1904. by their pouring of a little gravel on less than an acre
  1905. of land. Said Mrs. Sackett in the days leading up to the
  1906. Supreme Court decision, �The EPA can come in and turn your
  1907. life upside down. They can make you feel really small and
  1908. insignificant. And they take away from you your sense of
  1909. America.�
  1910.  
  1911.  The EPA is not content to obliterate property rights,
  1912. however. Recent actions taken against the country's last
  1913. lead smelting facility will affect the right to keep and
  1914. bear arms, as well, by substantially impacting the production
  1915. of ammunition. On December 31, 2013, the lead refining plant
  1916. closed for good.
  1917.  
  1918.  The St. Louis Post-Dispatch reported just before the
  1919. shuttering of the plant:

  1921.  About 145 employees of the Doe Run lead smelter [in Herculaneum,
  1922. Missouri] learned they will lose their jobs at the end of
  1923. December because of the plant�s closure, the Doe Run Co.
  1924. said Wednesday. An additional 73 contractor jobs also will
  1925. be eliminated.
  1926.  
  1927.  By forcibly closing this plant, the Obama administration
  1928. took yet another unconstitutional step � one that will
  1929. severely impinge on the nation�s ammunition-manufacturing
  1930. capability.
  1931.  
  1932.  Why would the Doe Run Company, the owners of the Missouri
  1933. lead smelting facility, agree to being run out of business
  1934. by the EPA? One word: extortion.
  1935.  
  1936.  In a document published on its website, the EPA explains
  1937. that in order for Doe Run to continue its operations, the
  1938. company would have to agree to pay �$65 million to correct
  1939. violations of several environmental laws at 10 of its lead
  1940. mining, milling and smelting facilities in southeast Missouri.
  1941. The settlement also requires the company to pay a $7 million
  1942. civil penalty.�
  1943.  
  1944.  In a statement to the press, Doe Run said the fine and the
  1945. required upgrades to its facilities were �too financially
  1946. risky.�
  1947.  
  1948.  In cases such as those of the Sacketts, the Doe Run smelting
  1949. facility, and scores of others nationwide, the EPA�s heavy
  1950. handed, unconstitutional tactics should have been investigated
  1951. and the nearly unbounded power should have been reined in.

  1953.  They carried on without oversight, however, and perhaps
  1954. now we know why.

  2136.  The York County Board of Supervisors is threatening the
  2137. livelihood of oyster farmers.  Zoning is a popular way for
  2138. counties to control where and how things are bought and
  2139. sold. Zoning ordinances can often dictate whether people
  2140. can work, live and play in the same neighborhood. The
  2141. details of zoning are excruciatingly complex leaving people
  2142. unable to respond in a timely manner. The enforcement of
  2143. zoning regulations involves heavy fines and/or incarceration.
  2144. In short, zoning has been a terrific way for counties to
  2145. control people�s lives.
  2146.  
  2147.  Such is the story of oyster farmer Anthony Bavuso and his
  2148. family. After years of working corporate and office jobs,
  2149. Bavuso and his wife took a short hiatus from the day-to-day
  2150. drudgery and returned with a new perspective: they wanted to
  2151. become contributors to the economy of raw materials by producing
  2152. something that people needed.
  2153.  
  2154.  Bavuso moved his family back to their home state of Virginia
  2155. with the dream of becoming food producers. Having access to a
  2156. waterfront property, and a background in oyster gardening, it
  2157. made sense to start an oyster farm. Like other types of farming,
  2158. oyster farmers have to manage the growth of their oysters � a
  2159. labor-intensive process requiring a high level of experience.
  2160. An added benefit, for Bavuso, was the knowledge that oysters
  2161. clean the water. As a lifelong Virginian, the health of the
  2162. Chesapeake Bay is never far from his mind. (Oysters eat algae,
  2163. which proliferates in the pollution of the bay, and turn the
  2164. algae into usable protein for humans.)  So the Bavuso family
  2165. started Seaford Oyster Company in Seaford, Virginia.
  2166.  
  2167.  York County maintains a set of zoning ordinances regulating
  2168. various aspects of farming.  There are a list of things that
  2169. are allowed, and if an activity is not on the list, the county
  2170. prohibits it. Penalties include steep fines and possible
  2171. incarceration. Small changes to the zoning ordinances can
  2172. easily disrupt industries and people�s livelihoods.
  2173.  
  2174.  In 2010, Bavuso followed regulatory procedure within his zoning
  2175. district for an oyster farm. He established a lease with the
  2176. Commonwealth of Virginia that gave him the �rights� to the
  2177. section of the bottomland in the Poquoson River adjacent to
  2178. his property. (The bottom lease gives farmers access to
  2179. shellfish only.) Additional regulations and permits involved
  2180. food safety. Wanting to show his interest in producing the
  2181. safest food possible, Bavuso complied with the entire permitting
  2182. process.
  2183.  
  2184.  Prior to starting the farm, the family looked at this list of
  2185. zones and restrictions. In the Bavuso�s zone, farming is �permitted
  2186. by right.� This means for people to farm the land, they need no
  2187. additional land use permits from the county. According to the
  2188. definition of aquaculture in the code, what Bavuso is doing is
  2189. considered part of what is �permitted by right.�
  2190.  
  2191.  By 2011, after more than a year of farming, refining his expertise
  2192. and growing his customer base, Bavuso read in a local newspaper
  2193. that the county was planning on rezoning to remove agriculture
  2194. activities from Bavuso�s �zone.� A �zone� is any area that the
  2195. county designates. Within each zone, the county stipulates what
  2196. particular activities can take place. Once designated, the county
  2197. applies regulations and restrictions. For example, one common
  2198. zoning requirement is that if an area is zoned for residential
  2199. building, there are restrictions and regulations determining
  2200. how from the property line a structure can be built.
  2201.  
  2202.  Bavuso wanted to make sure that he would be grandfathered in and
  2203. that these changes would not affect his farming operation. He
  2204. didn�t know it at the time, but the ordinance was crafted to
  2205. punish a fellow oyster farmer by the name of Greg Garrett. The
  2206. rezoning effort was a actually a political vendetta to punish
  2207. Garrett for supporting a challenger to a currently elected
  2208. member of the York County Board of Supervisors (BOS). Bavuso
  2209. has gotten caught up in that because he does not agree with
  2210. the agenda of the BOS either. And so began what would be at
  2211. least 3 years of limbo for a peaceful man and his family. After
  2212. his vocal opposition, Mr. Bavuso is now is convinced that they
  2213. are attacking him, personally.

  2249. convicting him on nine counts and sentencing him for 30 days

  2279. defunct Waxman-Markey cap-and-trade bill, a 1,428-page
  2280. behemoth that threatened to slam the brakes on the US
  2281. economy before it died in the Senate in 2010?

  2283.  That may seem unbelievable but it�s the likely end game if
  2284. courts uphold EPA�s draconian carbon �pollution� rules for
  2285. new and existing fossil-fuel power plants, which are almost
  2286. fully upon us. And American democracy will also suffer if
  2287. EPA goes ahead.

  2289.  EPA�s carbon rule, proposed last September, would use the
  2290. existing Clean Air Act to establish a new source performance
  2291. standard (NSPS)�a limit, in plain English�for carbon dioxide
  2292. (CO2) emissions that no commercial coal-fired power plant
  2293. can possibly meet.
  2294.  
  2295.  The proposed standard is 1,100 pounds of CO2 per megawatt
  2296. hour of electricity produced. Today�s most advanced commercial
  2297. coal power plants emit 1,800 pounds of CO2 per megawatt hour.
  2298. New plants could comply only by installing carbon capture and
  2299. storage (CCS) technology � a capability that can add 80% to
  2300. the cost of building a new coal plant.
  2301.  
  2302.  To make the proposal look reasonable, EPA has to bend reality
  2303. a lot. Under section 111(b) of the Clean Air Act, NSPS are to
  2304. reflect the �best system of emission reduction� that has been
  2305. �adequately demonstrated.� EPA claims CCS is adequately
  2306. demonstrated -- but there are no commercial-scale power
  2307. plants operating anywhere with CCS, and none is being built
  2308. without heavy taxpayer and/or consumer subsidies.
  2309.  
  2310.  In short, a utility that builds a new coal plant with CCS,
  2311. as required by EPA�s ruling, risks going bankrupt. The rule
  2312. is thus an informal ban on investment in new coal power
  2313. generation.

  2354. (78) EPA To EXPAND Use Of Bee Killing Pesticides

  2356.  The EPA wants to expand the use of two pesticides that
  2357. could be a major threat to America�s bee population, farms
  2358. and the nation�s food supply. That�s the charge being made
  2359. by the Center for Food Safety and beekeepers.
  2360.  
  2361.  The agency is proposing more uses for thiamethoxam,
  2362. apesticide that has been banned in the European Union
  2363. because it is considered a threat to bees. A letter from
  2364. the Center to the Environmental Protection Agency raises
  2365. some serious concerns about thiamethoxam and another
  2366. pesticide, sulfoxaflor.
  2367.  
  2368.  �Peer-reviewed scientific studies have consistently shown
  2369. that these systemic chemicals are highly toxic to honeybees,
  2370. other pollinators and beneficial insects,� the letter
  2371. states. �Pollinator losses represent a serious threat to
  2372. the agricultural industry and food security. Furthermore,
  2373. these systemic pesticides have also been shown to negatively
  2374. impact beneficial insects and contaminate water bodies and
  2375. soil.�

  2377. The Threat from Neonic Pesticides
  2378.  
  2379.  Thiamethoxam and sulfoxaflor are neonic or neonicotinoid
  2380. pesticides which studies have tied to bee deaths, as Off
  2381. The Grid News has reported. Last year scientists from Health
  2382. Canada (Canada�s Department of Health) found 70 percent of
  2383. bees that died from colony collapse tested positive for
  2384. neonicotinoids. AHarvard study this year also tied bee
  2385. deaths to neonicotinoids.

  2387.  �They�re taking in something that they will ultimately die
  2388. from, and they�re taking this into the hive and feeding on
  2389. it all winter, then we wonder why we have winter mortality,�
  2390. Madeline Chagnon, an environmental scientist at the University
  2391. of Quebec, said of bees and the pesticides.

  2393.  Chagnon says the pesticides enter the soil when they are
  2394. coated on seeds. The soil then becomes dusty and is stirred
  2395. up during agricultural processes. The dust exposes the bees
  2396. to the pesticides and eventually kills them. Bees can also
  2397. become exposed to the chemicals while pollinating crops.

  2408. building a stock pond on their eight-acre farm.

  2410.  Andy and Katie Johnson built the pond in 2012. They stocked it
  2411. with trout, ducks, and geese.
  2412.  
  2413.  Of course, the government is why we can�t have nice things.
  2414. Naturally, the EPA has found a reason to come around and harass
  2415. the Johnsons and prevent them from enjoying their property.
  2416.  
  2417.  Johnson said the EPA has engaged him in a power play and is
  2418. threatening him with massive civil and criminal penalties over
  2419. the pond, which they claim is actually a �dam.�
  2420.

  2425.  The agency claims Johnson violated the Clean Water Act by
  2426. building a dam on a creek without a permit from the Army Corps
  2427. of Engineers. Further, the EPA claims that material from his
  2428. pond is being discharged into other waterways. Johnson says he
  2429. built a stock pond � a man-made pond meant to attract wildlife
  2430. � which is exempt from Clean Water Act regulations.
  2431.  
  2432.  Johnson said that his pond is exempt from the law, and he
  2433. followed state regulations in building it. He has an approval
  2434. etter from the Wyoming State Engineer�s Office as proof, which
  2435. states:
  2436.  
  2437.  �Said permit is in good standing and is entitled to be exercised
  2438. exactly as permitted,� says the letter.
  2439.  
  2440.  The agency is threatening to hit the family with up to $75,000 a
  2441. DAY in fines. Johnson said he�s not paying them a cent:
  2442.  
  2443.  �I have not paid them a dime nor will I. I will go bankrupt if I
  2444. have to fighting it. My wife and I built [the pond] together. We
  2445. put our blood, sweat and tears into it. It was our dream.�
  2446.  
  2447.  Of course, the EPA isn�t backing down. They argue that Johnson
  2448. needs to either restore the land or pay the fines. On January 30,
  2449. the agency gave Johnson 30 days to hire a consultant to assess the
  2450. impact of the supposed unauthorized work and to create a restoration
  2451. proposal. That proposal has to be approved by the EPA, of course,
  2452. and it must contain a schedule. All work would have to be completed
  2453. within 60 days of the plan�s approval.
  2454.  
  2455.  Sounds like they are setting him for failure, doesn�t it? Even if
  2456. he DID violate the law and agreed to make things right, would meeting
  2457. those terms even be possible?
  2458.  
  2459.  If Johnson does not comply with those terms, the EPA is going to
  2460. fine him $37,500 per day in civil penalties, along with $37,500 more
  2461. every day for statutory violations.
  2462.  
  2463.  Johnson is fighting back and has gained the support of three Republican
  2464. senators � John Barrasso and Mike Enzi, who both represent Wyoming �
  2465. and Louisiana Sen. David Vitter, Fox News reports:
  2466.  
  2467.  The Republican lawmakers sent a March 12 letter to Nancy Stoner, the
  2468. EPA�s acting assistant administration for water, saying they were
  2469. �troubled� by Johnson�s case and demanding the EPA withdraw the
  2470. compliance order.
  2471.  
  2472.  �Rather than a sober administration of the Clean Water Act, the
  2473. Compliance Order reads like a draconian edict of a heavy-handed
  2474. bureaucracy,� the letter states.
  2475.  
  2476.  The letter also questions the EPA�s claim that Johnson�s pond is
  2477. actually a dam:
  2478.  
  2479.  �Fairness and due process require the EPA base its compliance order
  2480. on more than an assumption,� they wrote. �Instead of treating Mr.
  2481. Johnson as guilty until he proves his innocence by demonstrating his
  2482. entitlement to the Clean Water Act section 404 (f)(1)(C) stock pond
  2483. exemption, EPA should make its case that a dam was built and that the
  2484. Section 404 exemption does not apply.
  2485.  
  2486.  �If the compliance order stands as an example of how EPA intends
  2487. to operate after completing its current �waters of the United States�
  2488. rule-making, it should give pause to each and every landowner throughout
  2489. the country.�
  2490.  
  2491.  Johnson said his battle with the EPA is serving as a learning
  2492. experience for his children:
  2493.  
  2494.  �This is showing them that they shouldn�t back down. If you need to
  2495. stand up and fight, you do it.
  2496.  
  2497.  �This goes a lot further than a pond. It�s about a person�s rights. I
  2498. have three little kids. I am not going to roll over and let [the government]
  2499. tell me what I can do on my land. I followed the rules.�
  2500.  
  2501.  The infringement on Johnson�s property rights under the veil of
  2502. protecting the environment is bad enough, but some say that the
  2503. astronomical fines are perhaps an even bigger issue � and may even
  2504. be unconstitutional, as Evan Bernick of The Foundry explains:
  2505.  
  2506.  But the eye-popping aspect of this story is the severity of the
  2507. penalties threatened. It�s absurd to threaten someone with tens of
  2508. thousands of dollars in fines because he or she lacks a permit. And
  2509. it might also be unconstitutional.
  2510.  
  2511.  The Framers of our Constitution recognized that, at a certain point,
  2512. penalties become unconstitutionally disproportionate. The Eighth
  2513. Amendment�s Excessive Fines Clause reflects that understanding. In
  2514. Austin v. U.S. (1993), and again in U.S. v. Bajakajian (1998), the
  2515. U.S. Supreme Court explained that �[t]he Excessive Fines Clause
  2516. limits the government�s power to extract payments, whether in cash
  2517. or in kind, as punishment for some offense,� and held that civil
  2518. sanctions that do not serve solely remedial purposes are subject
  2519. to the Excessive Fines Clause. It is impossible to understand the
  2520. threatened fines as serving a purely remedial purpose�surely,
  2521. repairing any damage that Johnson inflicted would cost less than
  2522. $75,000 a day. But, under the terms of the CWA, he is potentially
  2523. subject to such penalties as a consequence of his failure to obtain
  2524. a permit.

  2526.  This is just another sad case of big government stomping all over
  2527. the little guy. Hopefully the EPA won�t get away with destroying the
  2528. Johnsons� hard work and are stopped from sending the family into
  2529. financial ruin.
